I just got off the phone with the guy in collections, he said he was a third party company. They received my cease and desist letter and will not be taking any money from my account anymore. However, he said that he could work with me and set up a settlement agreement or have me make installment payments. He claims that I still owe $562 on a $500 dollar loan that I got in 7/24/08, to date I've paid $675.00. He said that they don't have to follow Michigan Law because they are in Delaware and operate over the Internet. So, I told him that I would pay $50 every two weeks, yeah right, they are robbing me, so watch me rob them! Is there anything else that I can do at this point, I'm going to look of Delaware Law and see if I can find anything.


Michigan is one of the states that requires internet PDL companies to be licensed in that state so what he told you was a lie. If they're not licensed in Michigan then they are doing business illegally. Report them to the MI and DE state AG's, the FTC, the BBB and whatever regulatory agency that handles banking and finance in the state of MI.

I too have a loan with this lender and noticed that on their website, there is a disclaimer that basically states that the transaction is occurring as if physically within the state of DE. Not sure if this is their "out" in terms of compliance with the debtor's state laws? Can anyone answer this?

They have to follow Michigan state law. I used to be a third party collector. At this point they are harassing you after they have recieved your letter they were allowed to contact you one more time but noe that you set up another payment arrangment with them you may have gave then to ok to contact you again and you have just taken responsibility of the debt by saying you would pay. So resend the letter and next time they call let them know that you are recording the call and tell them to not contact you again and to cease comunication, but be careful if this debt is not more then seven years old and gets over seven hundred dollars legally your debt is in stat and they are able to sue you for it they probly wont considering it would cost more then your debt in lawyer fees but ypo never know. before you talk to them again look up the FDCPA these are laws third party collectors have to follow. You can also look up the laws they have to follow to be able to sue you as well in michigan.Hope i was able to help

If you overpaid, write them and tell them you want a refund. I did that, I sent a ticket to the BBB of Delaware and the Attorney General of my state, NY. I did this on 9/2/09. I got a refund check in the mail today, 9/21/09. I couldnt believe it myself but the letter and filing reports work.
