DIY Help in TX
Date: Sat, 11/08/2008 - 14:34
The problem is, most of my pdls are with storefronts in Texas, and I'm seeing that they are CSOs and protected with their seemingly illegal fees. And, a lot of them required a check when they issued the loan. My bank says that once I close the account, nothing will reopen it or post, but do I still send a letter saying that I'm unable to pay in full right now? Also, can someone send me a sample letter of how to revoke ACH for the other companies?
When can I request and expect them to stop calling me and my references? Is that something they have to comply with at the storefront level?
I'm so confused and feel at a disadvantage because of TX laws. I want to clear this up, but it will take a while, because I'm in waaaaaaaaaaaaaaay over my head.
If someone could breakdown the order of taking care of this, I will virtually hug you. Any help is greatly appreciated!

Don't even get me started on the CSO BS, it it just a nice and tidy way for these scum sucking companies to get around the lending laws. The first thing you need to do is get that account closed asap. Unfortunately since they are the original creditor they don't have to abide by collection laws, but them repeatedly calling your references could be considered harassment since they have no true reason to contact them other then to harass or embarrass you. Send them letters. One thing you might be able to do...I did it with the CSO payday loan I got.....they may be protected by the CSO standing, but the entity that did the actual lending is not.....basically they have a deal with some lender that they just help you get the loan, but this entity is the actual lender..so go that rout...make sure the LENDER is properly licensed and complying with all laws. I did this and it has been over a year and not one peep from the company, nothing on the credit reports either. Was one of your loans from Easy Cash by any chance? They are always right next door to an Easy Pawn shop...I don't think the lender they use holds proper licenses because once I pointed that out they shut up.

Yes, 2 of them are with EZ Money (my husband & I both have them). Could you possibly send me samples of any of the notices you sent? I'm not sure how to tweak the ACH revocation notice (that states the pdl is illegal) to fit with the CSO.
Thank you so much for responding! It's encouraging to know that someone else has overcome the pdl with cso nightmare. *hug*

its been so long since I did it I don't have it anymore. Basically you don't really need the revoke ach anymore if you close that account. I closed my account and opened a new one in the same bank and not one problem.
I am not even sure if I sent a letter to EZ at all, it was several phone calls when I was just learning about CSOs and this place...I asked them how they would like me bringing in the lender they have a deal with and suing the pants of them and naming EZ in the suit for unfair lending practices...I also mentioned that the partner likely wouldn't appreciate me dragging them into this. I never heard anything from them after that....no phone calls, no letters....nothing...its been either a year or a little over a year I think now...

So I researched my numerous CSOs and found that one of them is not registered in Texas. Has anyone found this before? Any luck? What's the best approach with that one?
Also, with the legal storefronts, can anyone share their experience with the "payment plan" and/or options the storefronts gave. I know I owe the debt and I want to pay them back, but I'm not sure I can pay what their "minimums" are right now. We're so behind on other bills that we're playing catch-up and don't have enough left to pay each of the minimums. Do I pick just one and buy time with the others sending it to collections? I'm ashamed to say that between my husband and I, we have over 14 loans.
I'm am completely drowning here, but feel that things have GOT to get better!

Has anyone been denied at the PayDayMax login? I re-sent my letter to them via e-mail yesterday & haven't received a response, but I can't log in to my account. I have reset my password twice, but it still fails. I'm scared to call them (I'm a wuss  ). Anyone else experience this? Is it a good sign?
I would greatly appreciate any advice/experience with this & the issue I postly before. The forum is a godsend for sure.

It's me again (Margaret).
RapidCashForYou.com has not responded to my letter stating that they were an illegal lender, but they DID pay off & reactivate my loan, essentially extending me another payday. What is that about?? Has anyone had a similar experience, and what should I do about it?
Thanks for any help, you guys. Please don't forget about me......I can't find similar situations on the board.

Oh my gosh.....seriously??? RapidCashForYou ignored my initial letter, but I received a phone call today regarding my debt. One phone call from Keith Pitt. He also sent an e-mail stating that I should call him, so I forwarded him the original letter, and his immediate response was a form letter stating that they couldn't possibly formulate a unique e-mail for each request and that my only option was to speak with him by phone. His e-mail also said that within one business day (without my response) that I could expect someone to contact my employer to verify employment, and that they would send a debit to my account.
Well....within ONE minute from sending the e-mail, he called my job to verify employment and sent an e-mail confirmation with RapidCashForYou.com at the top. Then, he called my references and told them where he was from, asking me to call him.
I resent the initial letter & he resent the form letter. Good gravy....we could play that game all day.
I submitted a complaint to the UT BBB, but I really don't know what all I was supposed to say other than they are operating illegally and that he wasn't even following his own guidelines. (Was I supposed to put a dispute amount & settlement request?)
I'm so aggravated at this slimeball that I wish him ill. What are my best actions now??
