I had been recieving internet payday loans and had been paying them off for about the last 6 months. when I realized that I was in way over my head, I decided to try to pay them off and stop. Then all HELL broke loose!! something came up and was not able to pay right then...now I'm receiving threathening emails from these companies. I couldnt believe it because I have ALWAYS paid my loans off and on time. The first time I'm late, they are threatening me...I'm tired of this vicious cycle, I'm ready to do what I have to do to get out of this. Can anyone help me as to what I can do next? I have 4 loans...I live in Ohio and I dont know what my rights or options are....One of the places, not only do I have to pay $189 service fee, they have tacted on another $58 for late fees. HELP!!


I live in Ohio, (sorry) I have a total of 6 loans (my error) with:

All of your Internet loans are illegal. You will only owe them the principal amount you borrowed, period.

I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. If I were you, I wouldn't worry about the illegal pdl's right now and deal with the store front lender first. Before you default, go to the store and ask for the EPP (Extended payment plan), an explanation of the EPP is below taken from the CFSA (Community Financial Services Association of America) site.

You are only obligated to pay back the principal amount you borrowed from an unlicensed/illegal Internet Payday Lender.

What next?

You may also search for addresses HERE at the Better Business Bureau.

File complaints: Most of the time, you can file a complaint online with the following, I encourage you to follow through with doing so, you will need to search the Internet for your state Attorney General's website, however, here are links to file complaints for the FTC, Online complaints: Federal Trade Commission., and the BETTER BUSINESS BUREAU.

Keep in mind that you may not receive a response for days, or even weeks, or, you may receive harassing and threatening phone calls. I have found the best way to deal with this is not to respond or reply, simply hang up.

Side note: If you have paid an illegal/unlicensed payday lender above and beyond the principal amount you borrowed, it might be a good idea to demand a refund and a paid in full letter/receipt. You may or may not get one or both. It still doesn't hurt to include that tidbit in your letter. :)[/quote]
