In 2007 I took out a payday loan with Cash Advance USA located in Florida. I am a Minnesota resident.

I paid 10 $50 payments and only borrowed $200. They are telling me that none of the balance was paid down. From what I can tell they violated MN and Florida lending laws and owe me money?

Cash Advance refered my account to Capital Collections. They are nasty people. Swear, yell and issue threats to arrest me garnish wages. They call me at work they did actually call my Human Resourse Dept to try to garnish wages. They decline to give me a fax or an address. So I cant send them a debt validation letter, or a do not call me at work note. They called me today 2/17 wanting the money basically yesterday. I cant pay them until next week and refuse to give them my bank information without them validating anything. What to do can they garnish my wages without proving anything to me? Help!


no they would need a court order to do that.it sounds like a bottomfeeder CA to me.it also sounds like your HR won't just give in to them.that is good.you are right about them owing you money.what phone# appears on your caller id?maybe we can get an address that way.

the number in which they are calling from is 1-888-579-8904 Rick Evens is who called my work and left me a nasty message on my phone. what do i do next I am worried...i cant have them calling my work and telling whoever answers threatening things and having them call my hr dept/

File a complaint with the FTC, your state Attorney General, and the BBB. It looks like you have around 6 complaints you can file.

They have to get a court order (or your HR dept's voluntary submission) to garnish.
