I want to thank you guys for all your help and getting my life back from these payday lenders. I want to ask how to deal with the letters I have been getting from collection agencies. I also got this email and would like to know how to deal with it, it seems like a trick.

You agree that PayDayMax.com and its successors and or assignees may contact you about your account using any contact information or cell phone numbers you provide, whether previously or in the future. You expressly agree to the use of any automatic telephone dialing system and/or automated or prerecorded voice when contacting you, even if you are charged for the call under your phone plan. The above provision will become part of your account agreement if you consent to the provision by (i) using your account after Tuesday, March 3rd, 2009 or (ii) keeping your account active after Tuesday, March 3rd, 2009. If you do either of these things, we will conclude that you have consented to being contacted on your cell phone in this way. If you do not want to be contacted on your cell phone in this way, you may call us at 877-937-3729 any time.


I'm sorry...i didn't catch that it was the OC. I saw this:

I interpreted it as applicable to a CA or telemarketer but only for calls to a cell phone. Harrassment is harassment. Regardless, the consumer can object to any part of that contract.

I got this one too from Payday Max (which I don't have a loan with) and one from One Click Cash. I am assuming that it is US Fast Cash is the one I had my loan through which I understand Payday Max to be the parent company of.

I sent the C&D letter that revoked my ACH and all contact with me.

I haven't accessed my online account with either loan, but don't want to call them either to tell them I do not agree, as I believe it is just a tactic to get us on the phone.

I am still haveing difficulty with both loans in getting my PIF status and continue to get weekly emails that they are going to exculate the collections.....

What other options could I have?
