fla payday loan

Made the first step by closing my bank account, would like
advice on what to do next. My payday loans are as follows:
Florida Resident

Paycheck Today borrowed 400.00 paid 360.00
United Cash Loans borrowed 500.00 paid 485.00
One Click Cash Borrowed 450.00 paid 675.00
Webpayday borrowed 950.00 paid 1,575.00
ACC (American Consumer Credit) borrowed 625.00 paid 125.00
Cash Star Group borrowed 300.00 paid 180.00
Paydaymax borrowed 630.00 paid 163.00

Are these loans legal any advice will help


Paycheck Today is not licensed in FL so that is an illegal loan. You only owe the principal which is $40.

United Cash Loans is illegal. You only owe the principal which is $15.

One Click Cash is illegal. You only owe the principal which you have already paid. They owe you $225.

Webpayday is illegal. You only owe the principal which you have already paid. They owe you $625.

American Consumer Credit is not licensed in FL. The loan is illegal. You only owe the principal which is $500.

Cash Star Group, I think they are illegal but I am not sure. Hopefully someone will come along that knows for sure.

Paydaymax is illegal. You only owe the principal which is $467.

Since you have already closed your account then you are on your way.

Next you need to send a letter to each of these companies stating that they are illegal and you are only going to pay the principal on these loans which most you already have.

Here is a template you can use. You need to tailor it to your state, state law and you loan information for each one.

After doing research regarding Internet payday loan laws in the State of _______, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of _____ in general:

Your State Information

I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have closed my account with the XXXXXX to protect my interest in this matter, per instructions from The _____ Department of Finance. I also revoke any and all wage assignments I may or may not have signed with your company, I no longer authorize you, your company, or your affiliates to attach any part of my wages or contact my employer for your collection purposes. I have notified my employer about this matter so any attempts to do so on your part will be rejected.

I demand that any contact be made through US Postal mail or email only. I will need everything in writing to keep accurate records of all communication as per instruction from my Attorney General's Office.
I prohibit you or your affiliates to contact me via telephone at my place of employment or my home
telephone number. I also prohibit you from calling my references listed on my loan.

Due to the fact that Internet payday loans must be licensed in the state of ____ to be a legal and binding contract, your company should NOT issue loans to ____ residents at all. I am requesting that you send me your license number which enables you to offer loans to ____ residents.

The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S.. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.

I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the ____ Attorney General's Office.

I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

Some people email and some send certified letters via USPS or both. I emailed mine and got quick results. The ones you have over paid may offer you a paid in full. For those loans you can add to your letter that you demand a refund. Some may give it but most people here are just glad to get a PIF response.

Since your account is closed the ones you owe may accept a payment plan. DO NOT give them your new account information if you opened one. Demand the payments be made via money order or a prepaid Visa card.

Thanks for the Info emailed and faxed the letters sent same letters to my employer as well, only been 3 days and so far PaydayMax has locked out me out of website. Unitedcash loans have me in collection level 2 whatever that means. Paychecktoday has a message saying to call customer service and belive it or not when I logged into ACC/cashspot website they our trying to offer me another loan. I am not sure what to expect next but I know for sure I will avoid panic and hiring someone to do this for me. I plan on letting these pdl's or collections know I will not be intimidated by idle threats and if they call me at work I do have the ability to have the phone switch board record any phone conversation.
