I took out a loan for 175.00 on 1/11/2013. The payback amount was 218.72 on 1/25/2013. My bank account was restricted due to fraudulent changes. This caused the payment to be returned. As soon as it came to my attention, I went online and paid it off in full with my visa card.

I recently noticed that the company assessed a 58.00 NSF charge. I called the collections department (Ecare) to explain the situation and the man stated that he would not refund the 58.00 fee. I respectfully asked that they withdraw this fee and stop calling me regarding this charge and they refused.

It has come to my attention that this company is illegal in my state. Also, the 58.00 fee that they are trying to collect is illegal in the state of California. My understanding is that payday loan companies have to be licensed in the state of California to sell loans here and have to abide by state laws regarding their fees. This company does not comply with either of these laws.

This company calls me everyday to harass me about this illegal charge that they assessed to the account. I want these calls to stop.


If they are illegal in your state - I would send them a letter still revoking ACH authorization an wage assignment. Since they are illegal you only technically owed them $175.00 - No fees at all should have been paid.. so you already over paid them by! I would demand that they remove the $58.00 fee and send you a refund for the over payment and send you a letter of PIF.

Great news.. That should help you.. If you can find a copy of the desist and refrain Order - I would attach when you resend the letter or email to them asking for a PIF on the account. remind them that you are filing the complaint with the CA department of Corporations also..

Thanks, I found out that the state of California filed a lawsuit against this company back in 2008. Aside from being unlicensed, the state of California- Dept of Corporations has demanded that they stop offering loans to people in this state. They have a "Desist and Refrain Order" against them. I filed my complaint with the CA dept of Corporations.

I followed the steps and they stopped calling. However, when I log into the account it still shows that I owe them 58.00. I'm hoping they remove this fee. I already reported them to the FTC and State Attorney General.

I sent the revocation letter, a copy of cease& desist order from state of CA and today is the first day I have not received a call from E-care in the last two weeks. Dana from E-care has been blowing up my phone. However the site still shows I owe them money. baby steps?

Yes, please keep us updated. I too live in California and have been through several high priced loans through PixyCash. I am about to send them a revocation of contract email. It looks as though they are in Malta so I have a feeling this will be a nasty battle.

Great news! I found a Desist and Refrain order against Northway Financia, aka PixyCash, issued by the State of California just last March! Attach the order to any further communication with PixyCash and hopefully they'll get the drift. :)
