I have used this website for AMAZING advice and have successful gotten out of many payday advance accounts closed and even received refunds by following these step by step blueprints. I used the same model for Sandpoint Capital but this morning the email was a little different. I currently reside in Florida and had a $300 loan out with them and have paid $180 so far, I sent them the email stating I would pay $120 only if it would close my account and this is the response I got. How would you respond to this??? I can afford the $300 but I dont want to spend if I dont have to, especially if they are illegal in Florida. Any advice??

With that being said when you applied for and agreed to the terms of the loan, it would have behooved you to read the complete contract you agreed to with Sandpoint Capital. You are a citizen of FL, however the contract was not made in FL. The contract was completed via the world wide web, the governing law (clearly outlined in your contract) which you agreed to by your legal e-signature are the laws of the jurisdiction in which the lender is located. When you spoke with Abigail on 7/30/12 at 12:41PM CST, she clearly outlined how the loan works and what the finance charges were, yet you still accepted the loan. Furthermore, this is your third loan with us.

Per the loan agreement, by revoking authorization for the lender to process payment from the account you in turn are authorizing the lender to prepare a payment to payoff the account when the loan comes due. If the payment is not successfully processed then you promise to pay the remainder of the debt by mailing a money order payment.

We are willing to settle with you for the principle amount remaining on your account. If making one payment to payoff the principle isn???t possible for you, then another payoff arrangement may be available. Please call to let us know how you would like to proceed and please request a supervisor. If no response from you by 9/13/12, we will debit $300 on 9/15/12 per the loan agreement.

They are feeding you BS. You are only obligated to pay back the original principal amount borrowed. Again, tell them that you are only paying the balance owed. Ask for an address to mail the payment or use prepaid debit card. If they don't agree to this, then they don't get their money and it is their problem.
