11/30 I received a call from a man named "Case manager Ray Smith" about a payday loan I defaulted on saying I needed to call in immediately to avoid legal action. I call this man at about 4:45pm after getting the voice mail and I am told by him to call back tomorrow and we will work something out. I call back the next afternoon at 3pm and talk to a woman who's name I did not catch who told me I had to pay by 5pm in full or they would move ahead with the case against me. Of course I do not have $488 to get them on the spot. She hung up when I said I could not get full payment by 5pm. When I got home I sent an email to their comments and suggestions email address noting that I had offered to make payments and that this had been refused. I got a call at about 1:30pm today (12/2) from collections supervisor John Lews again saying I needed to pay in full by this afternoon at 5pm. I told him the most I could possibly come up with $200 today. He agreed to this so I went back and went through all of my finances to come up with only $75 (rent is due). Not wanting to be a total tool and just say to hell with it I went to the ace store and made a payment in the amount of $75 which was accepted by the clerk at the store. 45 minutes later I received another call from this supervisor stating "One of my centers informed me you dropped off some fuel money at the store and you are welcome to go pick it up" so I call him back at the number he gave me and told him what the deal was and that I would pay them every friday until the debt was paid. I also told him I would not be going down to pick up the money that was accepted against the debt. He informed me that he would have the payment sent back to me and that they would continue to proceed forward with the case against me. What do I do now?

I'm in the same situation here in Texas. I owe them $333 and they will only accept the full amount. I told them I could break it up into 3 payments starting this Friday, which they refused. Kept telling me they were going to proceed with the case. She told me I couldn't make partial payments because it wasn't in collections anymore. I though about just going down there right now and just paying $100 today. I'm wondering how this will work. The "case manager" told me I couldn't do this because I took the loan out online. That's true but I picked up the money in store. They're giving me lots of conflicting stories, so I'm thinking it might be possible just to make partial payments in the store.

This lender needs to be reported to the FTC asap! There is a link in my signature to file a complaint, please do so because this company should not be permitted to treat their customers this way, I don't care if they are a CSO or not, it needs to be reported! Refusing payments and speaking in this manner to people is unacceptable. Please file complaints!

To original poster, I just wanted to let you know what I posted in my own thread dealing with the same problem and to tell you thanks for posting what you had gone through.

'Thanks! From the other thread where someone was having the same problem in Dallas, I decided to go to the store and make a partial payment there. At first she told me I couldn't make a payment because I hadn't gotten the loan there, but when I told her it was in collections she accepted it and just told me to save the receipt. I'll be awaiting a harassing phone call tomorrow, but now I can at least tell them they are liars because I could make a payment. I'll continue to make a payment until the store won't accept it. If they still somehow take some legal action against me within the next 3 weeks, at least I can prove that I was trying to make payments and I wasn't trying to steal or commit fraud or whatever else.'

Well my case manager called again this morning rather upset that I made a payment. She asked me why I did that. I lied and told her I consulted my lawyer friend like she told me, and that I was told that until I received written information that I was being taken to a civil suit or owed on an NSF, that I should make an attempt to pay that debt whichever way I could to show that I was not refusing to pay, and since I was still able to pay on that debt that meant it was still in collections and not in a civil case status. I also told her that she gave me wrong information when she told me I couldn't pay at a store because I took the loan out online. Of course she told me she never would have said that. She asked what my intentions were in regards to this debt. Told her that I planned to make payments until it was paid off and this was going to be my answer everyday she called. She said this was not going to make the problem go away because it was an NSF issue and that she was not going to be calling me ever again. I said that's great, but can you tell me when I can expect to be served with papers, go to court whatever so I can go ahead and pay this, to which she said "contact your lawyer friend and they can tell you."

I finally faxed them a letter stating that I would be paying $75 every friday until it was paid. If they did not except these terms I expected something in writing saying that they did not accept my attempt to settle this debt and anything other than a written document would be acceptance of my terms. I have not heard anything from them and am making the payments every friday. They will keep trying to strong arm you into paying it all until you make them accept the payment. The store will accept your payment then the collector will call refusing it, pay them no mind and keep making payments on the loan. Any payment they send back to you (from research on google) will make you no longer liable for that portion of the debt. So if you give them $50 and they send it back you would be responsible for 283 in theory. So far this has worked very well for me. I will find the letter I used and post it as well so you have somewhere to start
