My situation: Ca Resident defaulted on a 1300.00$ loan from zip19(northway financial,e care) due to be repayed on 7-02-10. Probably the 20th loan ive taken from them(scary!!),the fees and %s ive payed will 100% be greater than the $1300 principal borrowed and due at the moment.
Can someone advise me of my desired course of action?
Already im:
1. going to my bank tomarrow at 9am and demanding a ACH debit block,or freezing and a verbal guarantee that any fees incurred post freezing be absorbed by the bank if they do so occur.
2. trying to construct a letter but dont know what exactly to include? Revocation of wage ass.,california law concerning PDL,... If anyone could create a sample letter for my situation and PDL that would be wonderful i have two jobs and suck at computers.
3.can i fax the above mentioned materials?

FYI, placing a freeze on your account or blocking ACH is only a temporary fix with illegal lenders, and Northway Financial is definitely not licensed to lend in your state. After doing research regarding Internet payday loan laws in the State of California, I have found that your Internet payday loans are actually illegal. I have also found the following laws to be true applying to payday loans in the State of California in general:

I hereby revoke any and all ACH authorizations with your company from debiting any of my personal accounts, per Federal law, Regulation E Section 205.10 Preauthorized transfers. I have closed my account with Chase (ending in 2401) to protect my interest in this matter, per instructions from The California Department of Finance. The legal amount that could have been charged to my loan is the principal amount, even IF your Internet pay day loan were legal anywhere in the U.S.. I am willing to pay the principle amount of the loan only, however, this is only if you provide me with a physical address where I can send payments.
I must also inform you that I will be filing complaints with the Better Business Bureau, the Federal Trade Commission, and the California Attorney General's Office.
I expect a response from your company no later than 5 days from the above date regarding this matter. This response may only come via US Postal mail or email. No telephone contact is permitted.

Lol you have so much experience with this,you knew i was gonna fax it from my work. My reason for the fax was to speed up the process,should i not be concerned with how fast they're made aware of my intentions and just send it via snail mail?
Also what should my stance be concerning the nice lady whos gonna start calling me tomarrow morning wondering why i havnt paid?
1.tell her about the revocation and my stance concerning illegal lenders ?
2.,or just let it go to voicemail and wait for Northway to get the letter of revocation?

Honestly, it's quicker via email, and probably more effective (IMO and experience). I wouldn't bother sending letters via the mail, but that's your call.

I wouldn't even talk to them on the phone, hang up as soon as you realize it's them, because all they will do is harass and threaten you with crap they won't do. No sense in allowing them to ruin your day.
