I live in Texas and due to circumstances beyond my control, I defaulted on a payday loan. They have you make out a check to them and they hold it in case you default. They then try to deposit it and if marked NSF they prosecute or at least that is what they are threatening to do. Can they prosecute for a hot check? Some attorney representing the PDL keeps calling me and has now threatened that if my wife ( not part of loan ) doesn't give him her bank card number and let him set up $200 per month ACH then he will get me for a hot check.

I have had a store front PDL, I have defaulted and had the check bounce. I made payment arrangments. The most they can do is harrass you.
Do not give them your bank infomation. Pay using a money order or a prepaid Visa. Since they are lying to you already they may take out the entire debt rather then just a payment.
They are lying and threating you. You should make some payment arrangments with them and then report them to their corporate office and the attorney general.
