Yesterday I pulled up my banking info online to check my checking account balance. There were unauthorized charges to my account. The used the ach transaction process and actually printed there own checks with my name, address, ssn, my bank routing number, and my account number on them. Then they actually signed my name to the checks.

After going to my bank, and the bank doing their search...they found these charges are ALL associated with online payday loan sites. The bank immediately set in motion internet banking fraud papers. I had to fill out a police report. And the bank froze my account.

What I need help with is this...

I have payday loans. I live in Missouri. The bank wanted to close my account instead of just freezing it. But under Missouri Payday Loan laws I can be criminally charged if a payday loan payment is returned not paid due to a closed account.

The bank will not let me open a new checking account due to too many NSFs on my old account.

To top all of this off my payday loans are all going to be in default on their next due date because I have no money to pay them.

If the bank frooze my account (no ach transactions, debits, or credits) can be processed. Can the payday loan processors force my account open some how and process the payments anyway?

anyone have any ideas what i need to do?

sorry this is so "scatter brained" but with over $1000.00 in unauthorized charges to my account and payday loans coming due in which I have no money to pay I am really worried!!!


I am so sorry you are having this awful situation. I would contact your state's Attorney General office ASAP and speak to someone there -- explaining in full detail your situation and your bank situation. Is it possible for you to hard freeze your current bank account while also going and opening another new/secure bank account with another banking institution? That might be a way to be able to pay your living bills from a secure account while the "affected account" is frozen from allowing any PDLs to debit from it ... I imagine some of the more savvy folks on here will reply with some useful info ... GOSH, it seems so many of us across the country are in the ickiest situations with the horrible economy and no jobs or reduced wages, etc., etc. I guess it would be best if the laws changed to OUTLAW these PDLs unless they were legal and charged reasonable and doable interest rates ... until then ... so many people get trapped and drowned under so quickly once you get into this vicious cycle of borrowing from a PDL and trying to come up with their outrageous interest only pay-backs, which are DESIGNED to NEVER allow you to quickly pay down the principal ... I am so sorry you are in such a mess!

All the unauthorized charges were from pop up windows on a PDL site. What they did was steal my ssn, bank account number...etc. from when I was applying for a PDL online. Example of one, $7500 unsecured credit line, (you have to purchase items from their online store) for a membership fee of $49.95 and a reaccuring monthly charge of $17.95.

I didnt apply for the unsecured credit line or fill in my personal information.

They did not "steal" your information. They actually attached to the information that you provided for an PDL and you OK'd it by clicking the OK button and NOT unchecking the Opt In box somewhere. I feel for your situation, but you may have a tough fight on your hands because it sounds like you are getting debited by non-PDL companies that follow different regulations and requirements.

Am I following your situation correct?

the police contacted all of the companies that have attacked my checking account this morning and so far all have agreed to refund the funds to my account....however the bank has frozen and will not unfreeze my account to allow them to do this. The bank says "if we unfreeze the account it may just be a ploy for allowing them to take more, rather than replacing the funds they took."

The PDL companies are now threathing to have me arrested if the ach transaction does not go through my account. They all said that I can NOT revoke the ach transaction agreement I made with them!

If the bank frooze my account (no ach transactions, debits, or credits) can be processed. Can the payday loan processors force my account open some how and process the payments anyway?

I contacted a credit card company today to discuss options for payment. I am overdue and would like to pay, but have other bills as well and I'm trying to make due. I was informed that my account had been sent to the law office Mann Bracken. I was not informed of this prior to today. I was told that the account was switched over in June of this year. Is this legit? Should I call the lawfirm to schedule payments or can I request that it be sent back to Target?

sue.just know that is the first sign of an illegal lender.ACH debit consent is revocable.they can't and won't have you arrested.they also can't force your account open if a hard block is placed or it is frozen.

Why don't you start with this: Your account is frozen. That is actually a good thing in this case. Let the police and the bank do their research and try not to worry too much. Open a new account at another bank and immediately make sure your payroll is set up to be deposited into your new account. List all of the PDL's that you owe money to on this site so you can get some help...PDL name, amount of loan and the total amount you have paid to these companies. Someone on this site will be able to tell you if these loans are legal (store front) or illegal (most internet). If they are legal then they will work with you on paying them back if you call them--search for EPP on this site and you will find some great info to use when you call them. You can set up a payment plan--or, if you are able to pay them back in full on your next pay date, send them a money gram for payment. If they are illegal, follow the advice on this site. Believe me--it works. I e-mailed, faxed and mailed my cease and desist letters to my 2 illegal lenders last week before my payments were due and I haven't heard a thing from either of them. You can do this! Read all you can on this site and post your questions here for support. We have all been in the same boat and we are here for you!

is not from me.

What my bank and the police is telling me now is that they fully believe one of the PDL companies has sold my personal information. And that this is a form of identity theft.

I would contact the law office and find out what is going on and what you can expect. It is YOUR money and you have a right to be notified of what is going on....and in the mean time open a new account and make arrangements to pay anything urgent from your new account. Your current account is under investigation and even if the investigation ends, they will make you close it because your account info is in the wrong hands. I don't know if what the bank did was legit or not, but please open a new account elsewhere now before more bills come due. It is easy to get your account info updated with most companies...and usually it can be done online in a matter of minutes.

Payday one will work with you...they did me. They split my amount due of 572.50 into 5 payments of 114.50 beginning July 31st. She let me pick the date of my first payment to them. I just did this today - it was painless and a huge relief.

Think Cash is a legal lender like Payday One. You must stick to your payment arrangements with them or call to see if they have other options for you. You can update your account info on line in a matter of seconds when you get your new account.

I am not sure about the others, whether legal or not, but you can do a search on this site and you will find TONS of info.

I saw on one of your threads, they threatened to arrest you. TRUST ME..this is a ploy to get you to pay..they cannot arrest you..they are just blowing smoke. I have been in this mess and got out. you will be just fine:)..just pay them in installments

It would be very helpful if someone would make a list of every payday loan company, including the address, contact info, phone numbers, fax numbers, if they are CFSA members, and BBB members.

I will start working on that today and hopefully get a post in under new topic with all that info.
