Bank isn't helping me with ACH block

1. Do I have the right by law to ACH block or does my bank, by law, have the right to prevent me from it?

You have the right to revoke any ACH three days before they are due to withdrawl. That is the law and the bank has to honor that. Draw up the letters to the PDLs and show them to the bank.

2. If I become overdrawn because my bank won't ACH block at my request, what rights do I have to recovery of those funds?

If you put in the request three days before and they still allow them then you should be able to get all fees and monies refunded.

3. The 3 loans taken after Feb 1, is this illegal for the companies to have loaned to me, and, if so, is that enough reason to have the ACH block placed?

PA has special laws. The PDLs have to only be licensed in any US state and if they are they can lend BUT they need to follow the PA laws on payday loans. If they are not following those guidelines then they are illegal.

4. On the 3 after Feb 1st, will I be responsible for repayment at all if they are not licensed in PA and, if so would it be just the loan amount minus interest?

You would only owe what you borrowed.

5. Is my mapped out procedure listed above, ie. bank, pdl companies, ACH processors and then wage revokation, the right course of action?

Bank secure first. Maybe you should just consider closing the account. One the account is secure then the letters to the PDL which contains the ACH revocation and wage revocation statements.


I would get the letters ready. Print them all out along with a copy of the federal law that states you can revoke an ACH. You can find that here under #3 (c).

Take that to your bank and tell them you want to close the account due them being illegal/unlicensed and want a freeze on it so no ACH withdrawls can come through.

Then once it is froze/closed, send out the letters.
