I got a call at 9 this morning from a restricted number but the agency left a message saying I have a penalty against my SS# and I was going to be turned over to a county in Texas where I used to live. I called the number they left on my vm and it was CCR and Assoc. It was from a 3yr old payday loan and said I needed to pay the money or it was going to be turned over to the county. I said well im am not able pay anything at the moment so if its turned over where to I go to pay it? The lady didnt know and I told her I didnt live in the state anymore. She had my correct address in VA somehow and she said they would find me here. I asked why I have never received a letter or heard about this sooner and she didnt have an answer. What should I do? They said they would call back to see if the original company would make payment arrangements.


I believe Advance America is a Legal company and probably operating as a CSO in TX. I'd contact their corporate office and see if I could make some type of payment arangements.

A lady from Advance America said I had to call CCR and Assoc and doesnt know why I have never been contacted after all this time. So CCR called me back in the midst of all this and said I have two payment choices. I asked her to mail me a letter containing this info and it be explained to me. When I asked for a letter to be sent mrs. jackson (from ccr) sounded frustrated and said she would send an email in the meantime and hung up on me! So when I called back this other lady explained that they are just mediators and said they do not have to send me any letters.

Seems like they are giving you the run around. My understanding is that even Laywers are suppose to send you a letter with how much you owe and who it's for.

When I got an intent to "sue" the lawyers actually sent a letter first. (someone from my county this was for something completely un related). So I believe they still have to send you a letter. But I could be wrong, and someone else will correct me if I am.

They offered me payment arrangments via email and I called to accept them since I do owe the amount. I asked for an address to where I could mail a money order or western union. They said they needed a credit/debit card or check by phone to set up payments. I told the man my husband and I do not give out bank info. So I said you are refusing my payment and he said "yes". I said ok and hung up. I sent them an email replying to the arrangements...stating that I accept them and about the conversation just so I have it on record. Should I do anything else?

This is a blatant lie alltogether. SSN penalty?? Debts are civil matters not a criminal offense.

What you will need to do is ensure you have the payment arrangment in writing via email or USPS. Advance America is a registered CSO in TX, so this means they can take you to small claims court over the loan. Dont know why they waited three years to contact you with this, so use this in your favor :wink:

If you cannot pay by money order, then you can load a prepaid visa/mastercard. You can get them at check cashing stores or walmart. I suggest to cease communication telephonically if you already got a good email contact. This will help with your stress level, they can be rude :evil:

I took out a cash advance from cash net 3 yrs ago. today my husband got a call from the "fraud dept" lookin for me. I and from the state of pa and cash advances are no longer allowed in the state and have been " outlawed" for awhile now as I used to manage a cash advance (advance america.) can they sue me? I was always told thru our company that they would never sue because it would cost too much for a rep from the co. to fly to the state take it to a magistrate and just be told to make payment arrangements. correct???
