pdl's in AZ...illegal?
Date: Wed, 08/27/2008 - 08:29
One for 289 and one for 390.
My state requires no more than 3 "roll overs", then pay it in full and I can have a new contract. ( it also states I can't have more than one pld at a time, but for the sake of this arguement, we'll ignore that.
AIP I have paid 89 twice a month for a grand total of 17 payments on a 289 pdl. That's about $1513. If that's not over payment, I don't know what is.
Loanshop, under state law should have taken the full 390 last paycheck. But of course I have another charge that should be taken out this weekend.
What do I say to these people when I call so that they understand that I have seriously over paid and they have been making illegal withdrawals?
They have to abide by arizona state law in order to give a person from AZ a loan, do they not?

I'm posting your laws for good measure. Anyway, you need to complain to the FTC, BBB and your Attorney General's office about the illegal interest rate you were charged, I would also demand a refund! Do they say that you still owe them money? Have you checked to see if these companies are lending legally to AZ residents? You do realize of course you aren't going to protect your money from these companies until you close your account don't you. Go and open a new account at a totally different bank, then close this one out, otherwise these companies will not stop debiting your account.

I have not talked to them yet, and have been searching for a state number to speak to someone here.
I want a refund too!!!!
I will call the company to see what they say and then call my state. I also plan to call my bank before I jump up and close it because they tend to be good about handling unlawful charges....and these would be unlawful.
Closing my bank would cause more trouble than good since I have direct deposit and my company seems to be slow about change, as well as some direct debits taken out for things like, my car payment, insurance, ect.

Quick note...with LOANSHOP, I never recieved a copy of the agreement. The gentleman said we would do it over the phone and if I needed a copy of the agreement I could go to a web site to see a stanard copy of it. My name not being on it at all.
I'm calling the FDoFI in AZ tomorrow to make sure my bases are covered and I fully know what I'm talking about when I call these companies.
I have no problem paying the remainder of my loanshop one, illegal or not since I have infact spent that money and even if legal have not met the terms that would be covered by az law....but AIP is going to get an ear full. They've been over paid.
Unless they go by another name, they are not listed under AZ's list of licensed companies. Even if they were legal, they are still taking an illegal amount of money.
My intrest should be what? $18 per $100. And I've been paying $44.50 per $100 for longer than my state allows.
I think I have enough info to speak to AIP, give them enough rope to hang them selves and then seek action through the FDoFI and FTC.

AIP did not take another payment out, and LOANSHOP took out the final amount agreed upon.
I'm glad it's over, but I keep thinking about if I should have tried to get AIP to refund my $1200. They were civil, did as they have said.....but it's still $1200 that could go for other finacial issues, ya know?
If I have already cleared my account with them as PIF, am I able to go back and ask for a refund or did I miss my chance?
It doesn't hurt to demand a refund, if you have filed complaints
It doesn't hurt to demand a refund, if you have filed complaints (and I hope you did) that will give you some ammunition.

I called AIP to speak about a refund.
Of course I was tranferred around, and one woman had the balls to start yapping about how I agreed to the contract this and that. I started spewing off AZ laws and her response was " Oh, I don't know anything about that". Uh huh.
I got to "franny"s message and left one stating what I was calling for. 3 days later she has not responded.
I filed a report with the BBB, the FTC and will be downloading the conplaint for my state.
I'm half tempted to call her back ( she'll be doing more meetings or head counts I'm sure ) and leave a message saying that we both know I was going to get a refund....but she chose to take the difficult and legal way.
