AmeriCASH Loans - THREE YR OLD DEBT
Date: Thu, 02/26/2009 - 14:51
I got a call from them in DECEMBER 2008 stating that I owed $1972.09 on a loan generated in 2005, and that they wanted payment for it.
This has been the FIRST TIME they have contacted me! I have had the same cell phone number (I use it as my home phone) for the last seven years, and this is the first I am hearing that I owe almost $2000 to them. I spoke with a Mr.Butler, and asked why I hadn't been notifed of this debt earlier, and he said that letters were sent to my home and employer. I said that I had moved and never received any information from them concerning this debt, and that I would like a letter stating the validity of the debt sent to my current address. He says that the only "letters" he can send me will be a wage garnishment paper or papers serving me because they are taking me to court.
Honestly, I'm lucky they haven't tried to sue me at this point! THREE YEARS have gone by and I HAVENT HEARD A THING from this compnay.
I want to know that the debt is valid, but he says the only way to do that is to go to a store and have them print something out for me. I live 2 1/2 hours away from the nearest store!
Any suggestions on what to do?

Thier main office is in Des Plaines. If you call there, they should be able to get you the information that you need. Their number is 847-827-9740 and the presidents name is Dustin Mauldin.
The same thing just happened to me....
This debt is more than four years old and the same Mr. Butler is also trying to collect from me. This is insane. I haven't heard from this company in almost seven years and have not been contacted. I've lived at the same address for six years and I'm just now receiving a notification/. What's the recourse?

well well......where to begin??
First, to ciara--you need to check up on this company. AmeriCASH was the subject of a complaint filed by the SEC way back in 1992--here is a link to the complaint that the SEC filed their lawsuit with:
sec.gov/litigation/complaints/complr17526b.htm
Second, a class action suit against AmeriCASH was just filed in May, 2009, in Illinois. Here is a link that details this case:
lawyersandsettlements.com/case/americash-advance-class-action-payday-loans.html
I VERY STRONGLY urge you to contact the attorney mentioned in that link--the one that is suing these crooks. Especially since you live in Illinois. There are laws being broken like nobody's business here....dont let them steal from you too!
OK, now, lets take a moment and address a few statements that have been posted by "PDLowner".....
Quote:
None, you should make arrangements. |
This is, simply put, a ridiculous statement to say the least. What kind of legitimate business would NOT provide documentation? Suppose I knocked on your door and said "You owe me $10,000, now pay up" but offered no proof as to why you owe me this money.....would you write me a check on the spot? Would YOU "make arrangements" without proof? It's high time for people to get real.....The only business that would demand money under questionable circumstances and then refuse to provide even one shred of documentation to support their claim is a fraudulent one. NO reputable business that was legitimately owed a debt would not have the ability to prove their claims.....period.
Shaz, thanks for hitting me up about this one....I am going to keep digging and watching. There is not one thing legal about these clowns. For example, in Illinois, there is a law called The Illinois Payday Loan Reform Act(PLRA). The PLRA limits payday lenders to terms no longer than 120 days for their loans...but AmeriCASH has been charging 365% interest and writing loans for TWELVE MONTHS......they are in violation of so many statutes it isnt funny. The class action suit I mentioned is trying to force AmeriCash to refund every amount over 5% interest that these customers have paid to them through their fraud.

I did not bother to comment earlier, but skidivr really needs to check the facts. If you had done your research, you would know that there are 2 different Americash's. The one currenlty in operation in IL is an LLC and the last that I knew was privately held, therefore I believe that there is no reason for the SEC to be involved. Also, their thorough research would have show that they were not in existance until approximately '97 or '98.
It is much easier to diseminate incorrect information than it is to check your facts. Now, not all is incorrect, but you must be careful with your credibility...

I would say you have to look at the statuates of limitations for Illinois. I know that in Arizona if they do not collect on a loan for 3 years, then they can never collect on it. Now if you make a payment after 2 years and 11 months, then the 3 years start over again.

What type of loan is it?? payday or installment? It seems that Americash offers both. Without knowing the facts IMO it'd be little difficult to comment. Further, I agree with the above poster. Making payments just before the expiration of SOL would start it over again.
