can ameriloan take money out of my account

i sent ameriloan a certified letter not to debit my bank account anymore,but today they did so by a check can they do this


Tina, they are ruthless!

You have revoked the right to have them debit your account, yet they continue to do so. I have seen others on this board have success with going after them thru their ACH processor. You might want to give that a shot.

Otherwise, the only way to prevent them from taking $ from your account is to close it and open another one.

Get right on the phone call Intercept EFT at 1-800-378-3328, ask to speak with Cindy. Tell her that you have revoked authorization on your bank account but ameriloan is still trying to access it. I realize that they put a papercheck through but that is not to say that they will not ask Intercept to try and debit on a revoked account at some other time. Cover your bases. Then you need to send an email to Ameriloan letting them know that you have spoken with Intercept. When I called, Ameriloan had not tried to debit my account for several months but I explained that the possibility of them debiting did exist and I wanted it to stop. You have to stop them at every turn and be one step ahead to do so. Good luck. Keep us posted.

I would dispute the check with your bank and get them to reverse it.

This is a classic example of why it is important to close a bank account, because even when you revoke authorization to debit an account, they will try whatever trick they can!

I'm wondering if when a person sends in a revocation letter that they be very specific stating "that they revoke any debits such as ACH, manual check or ANY OTHER MEANS OF WITHDRAWING MONEY FROM SAID ACCOUNT."

ameriloan tried to do that with me a few years ago. I revoked ACH on my account and placed a hard hold on it. After the ACH was sent back to them, they generated a paper check with my account info and tried to send it through my account. Somewhere in their documents it states that if ACH is revoked they will generate a check for the full amount and send it through. Several of these payday loan places try to do this.

I just blocked an ACH debit from usfastcash yesterday and I'm nervous they will try to send the paper check through. I won't be able to put a hard hold on my account until Friday because I have a payment that was supposed to post yesterday that hasn't posted yet. I'm sending them out a letter today revoking authoriztion to make any further debits attempts on my account.

I placed a stop payment on their specific ACH entry last week and yesterday was the day it was supposed to come out, and the stop payment worked. I won't be able to put a hard hold on my account until Friday, so I'm hoping that will be enough time before they try to send a check through or change the amount. I'm sure they haven't realized the payment was blocked yet. I'm faxing, emailing and mailing an ACH revoke letter today.

Can you close the account completely? That would stop them from putting anything through. If you can, and you do, make sure nothing will force it back open again. I would suggest that once that C and D is sent, you give Intercept a call and tell them that you have revoked with ameriloan and your bank. Then pop off an email to Ameriloan letting them know that you have spoken with Intercept. They don't like being told that people are "telling" on them to the processor.

You have the right per the Electronic Funds Transfer Act to revoke reoccuring ach transactions. Checks are different. I don't think the ach processor would be able to help with paper checks.

If you look at your contract, it will usually say that you have the right to revoke ach transactions, and if you do, a paper check will be sent through, and that is not revocable.

This is why you need to close the account. Since you won't know the check number they will use, you can't stop payment on it.

goudah you are correct. Intercept can't help with the paper check but they can stop any further requests for debits on the revoked account. It doesn't hurt to put your dibs in. If they have debited before, they may very well try again. That is exactly what I told Intercept when I called them and it was nipped in the bud. You are also correct in that closing the account is the best way to gain control of one's money. Yes, it is a pain, especially when you have direct deposits, and other automatic ACH debits but to me it was worth the aggravation and time to make certain that my money was mine to do what I wanted with it. Actually, after I stopped my automatic debits, I chose to keep it that way so I could stay in control of my money, be it legal or illegal debts.

When I contacted Intercept about the check, they advised me there was nothing they could do, they had already put a stop to the ACH withdrawals. I was advised that I needed to contact the bank where the check was drawn, which was Chase or something like that. I had also sent something to Bremer bank, but they never responded.

dawn. . you will need to stop the check at the bank but it is good that the ACH debits will stop. Bremer Bank may or may not get back to you. It took a while before I heard anything and by then I had it resolved. Hang tight. Sometimes the wheels just move very slowly. If you can CLOSE your account. That will assure that nothing can go through. It's the only sure way to stop the nonsense. Keep us posted.

I have a problem with ameriloan, also! I closed my checking account and opened another one at the same bank and somehow they got my new checking account number and put it through...I have no idea what to do with them now!! Oh by the way I have joined the group but forgot my password and when i try to retrieve it I get no response. Just wanted you to know so I'm not showing up as a guest all the time!

I just went through this. My bank allowed me to put stop payments on the accounts using the companies name that way no matter what amount or form they use, they can't get it. My bank also told me that they were seeing a lot of this.......

You should check with your bank and see if they have some kind of policy that forces items over to the new checking account. I seen that in a couple of other threads. I know where I bank and also where I work we don't allow that. Did they do a ACH transaction with the new account or pass a check through. I would fill out a fraud report with your bank as well.

Closing your account is really the only sure way to stop it and even then some accounts will be forced open when a debit hits. I must have asked my bank a zillion times whether they would let anything go through. I think by the end of it they wouldn't let anything through just to shut me up! They promised me they wouldn't and they kept that promise. Dawn. . . I guess every black cloud really does have a silver lining! Looks like the dust is settling for you. Keep up the good work.

when they put the check threw the bank returned it for insufficient funds so then i called the bank and put a stop payment on the check so hopefully that will work plus i emailed ameriloan and told them they had no right to go into my account and if they do i will do a fraud charge

Basically they take advantage of people in hard times. I only boorrowed $300.00 and from the person on the phone informed me that I will pay back $390.00. Sounds good right wrong. After further investigation and after I have paid pack over $500.00 back I was told that I needed to contact them within 3 business days or they will charge me $90.00 per month for service fee and another $50.00 that only $40.00 would go to the loan. When asked how much would I pay back totally I was informed $950.00 total for borrowing $300.00 this is an over 300% return. None of this was explained to me and I wan to know how a so called business can get away with this. When I complained all I hear is" it is the form you signed" So to have them stop deductions I had to pay another $250.00 which means that to borrow $300.00 I had to pay back $750.00. Which is BS especially when times are hard. The businesses are only out get more money for you and not help in any way. I will be more cautious next time one and since I am a business law student I will see to that I personally take the time to see to it that corporate america no longer can rip off people who are just trying to make it.
