From reading all these comments has anyone heard if they are legal to garnish your check in Arizona from this company?

Thanks

I beleive wage garnishment is legal in Arizona but they would need a court order in order to do so. Payday lenders will also place something in the contract for wage assignment, this is a voluntary item, therefore it can be revoked at any time by sending a letter stating you are revoking their rights to place a wage assignment on any and all of your personal accounts.

Thank you Shazzers,

I received a phone call from them yesterday leaving a voice mail on work phone saying I needed to call them by 3:30 yesterday in regards to a date I would have to appear for. I didn't get the message until I came into work this morning since I was off yesterday and assume it is for a wage assignment. Is it too late to send them that revocatrion letter you are talking about????

Thanks

I'm sorry to tell you this, but there is only one sure way to stop the withdrawals, and that is to close your account. If that isn't an option, then tell the bank to put a hard debit block on your account. Before you close your account, read this information at the link below. http://www.debtconsolidationcare.com/paydayloan/close-account.html

Please do not let any of these pdl's know you are going to close your account, until AFTER you have done it!

Here's a copy of a wage assignment/eft revocation if you would like to use.

The date
Your name and address
The name and address of the creditor
Your account number with the creditor

Dear Sir or Madam,

I hereby revoke your right to use any wage assignment I may or may not have signed with you. You no longer have my permission to use this wage assignment. I am also revoking your right to debit any and all of my personal accounts per the EFTA, regulation E, which is a federal law. If you fail to abide by my wishes, there will be consequences for your actions as I am sure you are aware. I have sent a copy of this to my employer and my financial institution, therefore any wage assignment or debit request made by your company will be denied. I would be most happy to make payment arrangements with you and forward payments via USPS with money orders, please send me a valid address where I may send payments for the remaining balance. If you deny my request for an address, I will NOT send payments, in other words, no address, no payments. This is my final offer.

Sincerely,
Your signature
