Needing Help in Arizona
Date: Thu, 03/26/2009 - 12:56
I wish had found this site earlier. I was foolish enough to get myself in this trouble and on top of that I contacted PDL Assistance and got talked into using their services. UGH! I am currently trying to get my money back from them.
Here is my problem. I have a ton of loans and after doing some research this morning I think many of these companies are doing business illegally in AZ.
I have sent out the request to stop the ACH transactions, although none of them have stopped and now my checking account is so overdrawn with fees I don't know how I will ever pay it off. My bank has been a nightmare. They will only offer to do stop payments and are refusing to put a hold on my account while I sort all of this out.
Any advice will be appreciated.

Who is Cash Advance USA?????
I just got a call from some "attorney" claiming to be from Affiliated Consolidation Services.
And I do not know who Cash Advance USA is, do they have a million other names? Are they legit in AZ?

I have read other posts that state they are a collection agency, in my opinion, probably a bottom feeder (based on some of the things they have done). Next time they call, tell them they have 5 days after their first initial contact with you to send a dunning letter via USPS, THAT is a federal law. If they really are any type of legit company they will already know this. If and when they send you a dunning letter (google it), it should state that you have 30 days from the date of receipt to send them a validation letter, PLEASE make sure you send a validation letter! You have the right to MAKE them prove they are legally able to collect this debt and that YOU owe it. If you need a better understanding of this process type in "validation letter" into the search box located in the upper right hand corner of this forum.

I have sent validation letters to the original companies and the "collection agency" said that they do not have to send me anything.
I have never received any validation of debt for any of the companies and I have been sending letters since March of 2009.
So far none of the illegal companies have actually done anything but threaten me.
Since they are refusing to send me anything, they say I already have all of it, shold I keep ignoring them?

Read about collections below:
[QUOTE]What Must The Debt Collector Tell You About The Debt?
Within five days of their first contact with you, the debt collector must send you a written notice telling you:
- How much money you reportedly owe;
- The name of the creditor to whom the debt is owed;
- That unless you, within thirty days after receipt of the notice, dispute the validity of the debt or any portion thereof, the debt will be assumed valid by the debt collector;
- That if you dispute the debt in full or in part within that thirty day period, the debt collector will obtain verification of the debt and mail it to the consumer; and
- That upon your written request within the thirty day period, the debt collector will provide you with the name and address of the original creditor, if different from the current creditor.
The first notice must also include a warning known as the "Mini-Miranda Warning", which must state that the communication is from a debt collector and that any information obtained may be used to collect the debt. Except for pleadings associated with a legal action, all subsequent communication from the debt collector must also include this warning.
Please note that the thirty day notice requirement does not limit the debt collector from taking other measures to collect the debt during that initial thirty day period, as long as its action is not inconsistent with your right to contest the debt under the FDCPA.

I have found all of the emails and faxes I sent requesting validation of the debt and I did not receive a reply to any of my requests.
I sent proof that I paid back more than I borrowed and proof that they are illegal in AZ.
Should I offer to send this information to the "Collection Agency"?

They work with pdl companies. One thing you definitely need to do is make sure you know your rights. If they are harassing you on the telephone you need to follow the instructions I gave you above to assure they don't have the opportunity to receive a default judgment in a court of law. If you have sent a letter of validation to them I am assuming you sent it certified mail with a return receipt requested? Make sure you KEEP that green card they signed to accept the validation request. If they DO decide to take this to court whatever you do SHOW UP in court, take the green card with you to prove that you requested validation within the allotted days after you received a letter of collection from them. Also let the judge know that they never validated the debt but continued collection efforts during the validation period, that is a violation of the FDCPA, you could and should sue them.
