When you applied online for a payday loan, you solicited our company for the loan. If you read over the attached documents, you will find that you are under contract by our state laws we are liscensed ( that's right...they mispelled licensed) in.
You defaulted on the agreement and the account was sold to I-Collect, who then works with multiple collection companies to collect the debt.
On 9/29/08, we mailed out a letter to your home address explaining what had happened.
The collection company no longer has your debt, it was withdrawn by our company. If you would like to call and set up arrangements to payoff the debt, you may contact us directly. Your balance is $400.00. Please call us at 1.866.355.7308 and a agent from Customer Service can assist you. Thank you.

did you file AG complaints?if not do so.what state are you in?
if you are in a state that prohibits pdl's they are responsible for knowing that.i wouldn't worry about them.just file that complaint asap.inform ARROWHEAD that you are doing this.also file complaints against all agencies that contacted you regarding this loan.

I live in New York. I know it's illegal. The AG 's office sent me a complaint form. How can Arrowhead have a contract that trumps NY state law?? I mean is that even possible?

If they supposedly removed my account from the collection agency they used, why in the hell am I still getting harassing phone calls!!!!!!!!!!!

If your company withdrew the debt, why am I still getting harassing phone calls at work? As a matter of fact, I got 6 today! I now have on my voicemail a company stating they are trying to collect a loan i had with Arrowhead Investments telling me I'm going to be fired from my job ( illegal according to the Fair 1) arrested ( again, illegal according to the Fair Debt Collection Act) and they left the same messages with my two references ( illegal number 3).
What do you suggest I do then? Because according to the New York Attorney General's office, there's lots of actions I can take....specially considering you told me that the company no longer has my debt.

no illegal pdl trumps NY law.fill out the AG complaint form as good as you can.then inform whoever is calling that you have done so and hang up.try to get a name of the place they are claiming to be.try to get an address then hang up.this place is a bottomfeeder pdl who was put in there place by my IL AG.just fill in the complaint form and don't talk to anyone contacting you about this.

Very nice email. Because they are illegal in NY, the company doesn't really have a leg to stand on. They will try to get their money back though, so be prepared for some more phone call's until everything gets straightened out.

"Governing Law: Both parties agree that this note and your account shall be governed by all applicable federal laws and all laws of the jurisdiction in which the lender is located, regardless of which state you may reside, and y signing below etc etc....
and obviously I signed it. So, does this mean although New York says it's illegal...that it doesn't matter because I signed this?

all illegal bottomfeeders have that in there contracts.it still doesn't matter.when i first started my battle with the illegal bums.i thought the same thing,but my AG put my fears to rest and it's been a good ride since.also the people on this forum helped me too.

Two parties in aggreement cannot change the law. Only legislature can change the law. That would be like someone from NY placing an online bet in Vegas because the gambling establishment is in Vegas. He would still be breaking NY law regardless of who signed what! That would poke holes in every state law there is.
