Cash in a Wink PDL
Date: Thu, 09/13/2012 - 11:40
I live in OH and took out a PDL with Cash in a Wink (a Delaware based company). The original loan amount was for $500 and I have made 2 pymnts for $125.
I sent them a letter explaining that the loan was illegal in OH and that while I was not obligated, I would be willing to repay the principal that I still owed ($250) and gave them a repayment plan. I asked them to communicate w/me via email only.
The continued to call me, as well as my place of employment. I resent the letter and they said they would need to speak to me directly. So I did call, hoping they would be willing to work with the terms I outlined. The woman I spoke with said the acct is in collections and the total amount due was now over $700 and that the LEAST amount they would accept would be $625 - they were willing to do that since I had made two fee pymts already. I asked how that was a reduced amount since they were asking me to pay the original loan amount plus finance fee?
I also explained that the loan was illegal in OH and that I am not bound by Delaware law. So they could either accept the terms I outlined, or I would not pay back anything. She kept telling me that I was wrong and that I owed the full amount, which I told her I would not pay.
Anyone else dealt with them? Any suggestions for a next course of action? I have already filed a complaint at BBB against them.
thx, cmw
