Hello, I intially took out a loan with the VIP Loan Shop back in May for the amount of $200. With the bi-weekly payments, I was paying $75.00 for six weeks. Needless to say, I closed my bank account. Once this was done the account went into collections and they had an outside debt collector by the name of Total Recovery to contact me today, September 21, 2011. They asked me was I aware of a clause in the contract that I signed stating that they could get a third party involved to get a court order to garnish my wages. So immediately I set up a repayment plan. I live in the state of South Carolina and I remember distinctly not signing a contract because it was one of those no faxes PDL and everything was done on the phone. My question is, is this legal?

not only is VIP loanshop not legal in SC.it's not legal in any state.that being said you say this place was debiting from may until this month?then i'm confident that you overpaid on this.btw since this is an illegal lender then the contract is worthless.stop whatever method you gave to the bottomfeeder and as SOAPLADY advised.tell them to shove it.

Both of my previous posters are right. As the lender is not licensed in your state, so you can get rid of the debt by paying them only the principal amount. If you have paid them more than the principal, then ask them for the refund. Close your bank account asap. Check out the following link to know how to deal with illegal lenders:
