A person issuing bad checks in Colorado are liable for civil as well as criminal penalties.
A bounced check is not a "bad" check if it was written from a op
A bounced check is not a "bad" check if it was written from a open account at the time it was written.
You can not be prosecuted for a bounced check nor a defaulted loan.
The only thing a legal lender can do is file a case in civil court and get a judgement to garnish.

The name was B&R check of denver CO. Thanks for the response , but now I will be going to civil court on Friday and they added another $540.00 on the account for attorney fees and court costs . My employment situation has changed and I am only making about half of what I was making before . do you know if there is a way to get these fees removed or do I have to pay full amount which is more than double original account

Where you actually served with papers? How much was the initial loan for? Did you make any payments toward the loan?
Did you re-loan at all and how many times?

The information nohiogal has given you is great!!!! Keep in mind when you go to court, the payday loan comapany can only collect on what the judge determines to be fair and reasonable. I am not saying there will not be additional fees but what they ask for and what they get are two different things. I am sure the judge will take into account your employment situation as well.
