Payday loan "situation" in ct
Date: Wed, 11/23/2011 - 16:54
I've been reading up on this forum for a few months. I finally joined so I could hopefully get some feedback on my situation. I have FIVE payday loans at once, and live in CT. Here are the companies:
PAYDAYMAX - internet
MY CASH NOW - internet
ADVANCE ME TODAY - internet
AMERICAN WEB LOAN - internet
M1Y MARKETING (which has suddenly changed their name)
I have balances owed on each one of these. Paydaymax, my cash now, and M1Y are companies I've used several times each and have wasted thousands of dollars on fees and extensions. I did have one previous loan recently with each American Web Loan and Advance me Today in which I paid fees and interest above and beyond the principle borrowed.
After reviewing some of the postings on this site, I found the letter to send to each of these companies. I compiled information before defaulting and having them block the access to my account online for all previous loans. I calculated how much I paid above and beyond interest and calculated that along with the principle amounts I currently owe. In two cases, Advance me Today and American Web Loan, I still owe them in the end. I drafted the letter, included excerpts directly from their sites showing the thousands I've paid. I faxed each one of these companies my letter, with proof, and oh, previously, went to my bank and closed the account...and reopened. (basically the same account with a new account number)
M1Y immediately responded with the fact that I waived rights to my state's laws when I signed the contract...ok, i knew that was BS, so I just let them know that I"d be contacting the AG in my state and pursuing a refund of $3300 in fees I've paid them over the past three years. Suddenly, they told me i could just pay them the principle....well, uh, no, you owe ME money. To be a sport, and to Cover my own, I responded asking for a mailing address. I never heard a response. I asked one more time....it's like they fell off the face of the earth. That was almost two months ago.
The other four companies all received the same correspondence from me:
1. Advance me Today - no reply at all. no phone calls, no emails, no nothing. when I login to their site, the balance is still there but nothing has been added to it in fees.
2. PayDay Max - no reply, but my account now indicates that I need to call Credit Protection Depot to get balance information. They owe me money!
3. My Cash Now - same deal as PayDayMax
4. American Web Loan - had trouble finding a fax for them, so I just kept sending my letter via their link "contact us". I kept getting a stupid automated reponse from them indicating that nobody was reading it. finally I wrote back preempting the letter with "COULD SOMEONE ACTUALLY READ THIS" . I received one voicemail that i needed to pay or they would take legal action since they were "allowed to do that". That was six weeks ago. Nothing since. When I login to my account on their site, it shows my next payment due a month ago, but they are adding the fees...shows I owe now $1600 on a $380 loan. Weird.
I have asked the two that there is an honest amount owed to (after deducting my finance charges for previous loans) for mailing addresses. They simply are not responding.
Can i expect to ever hear from the five above???? It's really odd to me. Not even a harrassing call (not that I am complaining).
Any feedback would be appreciated.

Welcome to the forums!!!
The most important thing you should know is that payday lending is prohibited in CT. So all of the lenders are illegal here. You owe the principal amount only. You will be happy to know that illegal lenders can???t take any legal action against you. Ask them for the refund, if you have paid back more than the principal. Close your bank account immediately. You need not to make any payments until they are sending you a valid address.
No reply at all
Thank you! I do owe two of them money, but cannot even get them to respond let alone provide an address even though I have asked several times each. My fear is that one of these days it'll show up on my credit report. :???: it's been almost two months and there's been absolutely no response to my letters.
okay
you are doing fine, but you need to do more.like file AG,AND FTC complaints against all of your lenders.no pdl is legal in CT and you seem to know that.now here is some more info on a few of your lenders.
1)both PAYDAYMAX,AND MYCASHNOW are affiliated.basically the same lenders under diff names.they are not based in the US.
2)credit protection depot is located in CANADA and can't do a thing.
3)american web loan is "tribal"meaning they are just about a foreign pdl.they also can't do a thing.
now that being said did you follow the sticky tothe letter?meaning did you give wage assignment revocation letters to your HR/payroll person?if so then you hae nothing to worry about.last thing.the reason some are ignoring you is they are plotting their next move.they are illegal know it and also know that you kow it.file the complaints and keep us posted on anything regarding these illegals.we can advise further from there.
I plan to give our payroll person the letters I've sent to each
I plan to give our payroll person the letters I've sent to each PDL. I used the letter I found in the template which included the revocation of wage assignment. hopefully that covers me there. I already sent a copy of each letter with details including the illegal fees paid to the AG in my state and plan to file complaints with the Dept of Banking in CT and also the FTC. Sadly, the amount of illegal fees are close to 4k that I have paid. Is there any way the AG can help me to recover any of this?? One company wrote to me today (M1Y) and is insisting that I waived my rights when I "signed" (typed my name) in the contract. I told them they were wrong and to provide a mailing address although over the course of three loans they actually owe me close to 1500. What a mess.......ugh. Thanks so much for the feedback/advice! So glad I found this site.
The loans are ILLEGAL...the AG cannot force a foreign company to

Collection Letter Received - Farrell Law Group
I have an update. I've heard nothing from any of the pdl companies from my previous post for months. Not a single phone call, email or letter....until now.
I received a letter from Farrell Law Group, LLC in Kansas City, MO regarding American Web Loan. Not sure if they are licensed in CT nor how to find out.
The original loan amount from AWL was $600. Total paid was $540 in fees. I had sent them a letter back in September asking for an address to return the $60. I got no response but the letter from Farrell reads as below:
Our law firm has been retained by American Web Loan, Inc., a Otoe-Missouria Tribe of Indians tribal corporation, to resolve the following delinquent matter. American Web Loan's records indicate that you have an unpaid debt as listed below:
Amount due: $1320.00!!!!
Please return your payment in the amount of 1320. At this time no attorney with this firm has personally reviewed the particular circumstances of your account. However, if ou fail to contact this office our client may consider additional remedies to recover the balance due.
It goes on to say I can make payment arrangements, and gives a website to make payment. Idon't think so.
Unless you notify this office within 30 days after receiving this debt that you dispute the validity......
Ok, so here are my questions:
1. Is this CA licensed? Are they licensed in CT?
2. PDL's are illegal in CT....so what can they do?
3. Should I reply to this letter in writing, and what do I say?
4. Do I contact the AG in CT? The FTC?
5. Can they put this on my credit report??? I am worried most about this.
Any help would be greatly appreciated.
Thanks!
Letter from Farrell Law Group - American Web Loan
I apologize in advance if this is a duplicate post. I couldnt tell if my last one loaded or not....
I have not heard a thing from any of the five PDL companies since sending letters to them all. Not a single email, phone call, letter, until now.
I just received a letter from Farrell Law Group, Kansas City, MO. Original Loan Amount was $600. I paid $540 in fees and my letter to them indicated that I needed an address to send the $60 I owed as the loan was illegal in CT.
I don't know if Farrell Law Group is licensed in CT, nor do I know how to find out.
The letter reads:
This is an attempt to collect a debt.....
Our law firm has been retained by American Web Loan, Inc., an Otoe - Missouria Tribe of Indians tribal corporation to resolve the following delinquent matter. American Web Loan's records indicate that you have an unpaid debt as listed below:
Amount due : $1320.00 (NOT happening)
At this time, no attorney has reviewed the particular circumstances of your account. However, if you fail to contact this office, our client may consider additional remedies to recover the balance due.
Please return your payment in the amount of $1320.00. Your check or money order should be made payable to the Farrell Law Group, LLC.
You may also visit www.payflg.com to negotiate a payment arrangement.
For all other inquiries, please call.....
Unless you notify our office within 30 days and dispute the validity of this debt or any portion thereof, we will assume it is valid, blah blah blah
I have some questions:
1. Is FLG licensed in CT, and are they legit? How do I find out?
2. How do I respond to this letter?
3. Do I contact CT AG office, FTC?
4. Can they report this on my credit? I am very worried about this one.
5. Do I send the $60?
6. Should I include a copy of the letter I sent AWL?
I would greatly appreciate any feedback. Thanks!
respond this way
send them a letter stating this and only this.
since no pdl is legal in CT especially tribal lenders.i only owe 60.00 on this.and seeing as that fact plus you have to sue in CT i doubt you can do that.i owe 60.00 on this illegal loan.prove otherwise.
just like that.now do a search for farrell law in the bar top right.a complete bottomfeeder.btw this is rare as farrell usually calls and breaks the law with those calls.they never send letters.
