Western Sky/Cashcall letter - basically they confirm their loans cannot be enforced
Date: Wed, 06/27/2012 - 23:01
I have a loan with Western Sky ("sold" to CashCall). Made a few payments but did not pay the principal.
Sent them a notice revoking ACH etc. They sent a letter in response. So I'm reading their letter and it looks like they are basically confirming Western Sky loans cannot be enforced, at least in my state. Here is what it says:
"Western Sky is a wholly Cheyenne River Sioux Tribal blah blah blah....
Western Sky loans are initiated, approved, issued and disbursed within
the confines of the Cheyenne River Indian Reservation. Western Sky is licensed with the Cheyenne River Sioux Tribe. Western Sky does not have any physical presence in your state or any other State of the Union. The laws of the Cheyenne River Sioux Tribe apply exclusively to the terms and conditions of your loan, and you further accepted this choice of law and jurisdiction by executing your
loan document."
I THINK it means they cannot do anything. They can call me, they can even sue me, but they will withdraw their complaint before the court date (read something like that on these forums).
They are not licensed in my state. They are not licensed in any state. No FDIC insured bank "backing" them.
Screw you and your "tribal jurisdiction", assholes.
Anyone thinks otherwise?

The letter also says "upon receipt of your request, CashCall cea
The letter also says "upon receipt of your request, CashCall ceased all verbal
attempts to contact you in accordance with FDCPA guidelines, and took steps to ensure that all future correspondence will be in writing only."
But they called me 3 times already. :)
Guys, don't be afraid of these morons, stop paying and forget about them.
