It is a depressing day in NE. I have just received my second rebuttal from Ameriloan regarding a BBB complaint. I do not understand how they can keep saying "specific questions to my account". I gave them my own amounts. Here is copy of my second complaint

The request that I sent to them was in my own words. I don't know what template they are talking about. I repeat I WANT A REFUND ON MY OVERPAYMENT. WHAT THEY ARE DOING IS WRONG AND DISHONEST. DON'T CARE ABOUT TRIBAL IMMUNITY. THEY ARE BREAKING THE LAW

AMERILOAN RESPONSE
We stand by our response, before this complaint she sent in a well known form letter she then copied her states info into. The terms and conditions were met, and the customer was aware of them from recorded communication we have with her. Unless she has a specific complaint re: HER account, we cannot and will not address this.

CONSUMERS FINAL RESPONSE
The form letter that you speak about was used to revoke the ACH debit authorization from my bank.
On December 15, 2008 I borrowed $350, total payments $450. On December 31, 2008, I paid $105; On January 30, 2009, I paid $105; February 27, 2009, I paid $50 and $105; April 1, 2009, I paid $90; May 1, 2009, I paid $50 and $90; NO MORE MONEY. i overpaid you.THIS IS MY ACCOUNT THAT I AM WRITING ABOUT. I DEMAND A PAID IN FULL STATEMENT AND REFUND. I STAND BY MY RESPONSE.

Apparently, this is the final offer Ameriloan will make. What do they mean by "specific complaint"? What do they mean by "recorded communication". Is that phone calls or letters?

Has anyone had any luck getting pifs or refunds from Ameriloan or 500fastcash. BBB will probably close this complaint file now. Where next. Haven't heard anything from NE Banking and Finance. Do these companies get off scott free.

What account are you talking about, your bank or your account with payday lenders. I borrowed $350, was supposed to pay back $455, paid $720, found out they were illegal, so have since been trying to get a refund of the overpayment. Bank account was closed, so no more money could be taken out. Once they received the C & D letter, I never heard from them again, no phone calls, no letters, I am the one contacting them for the refund. They asked me one time to call about my account, but I never did. It would end up in a battle.

That's a typical response from Ameriloan. They aren't licensed to lend so it makes no difference whatsoever how they respond, they must meet your terms, any threats they make or assumptions are meaningless. They have NO legal leg to stand on. I wouldn't argue with them, I would make your terms clear, they can take it or leave it.

Ameriloan, 500 Fast Cash, United Cash Loans are all the same company. And like Shazzers stated are all illegal. If you have paid back all the principal amounts borrowed.........tell them thats it! I doubt very seriously if you will ever get a refund from those idiots!

Make sure you secure your bank account! Hard debit block or close it. They are known for drafting funds in which they are not intitled to.

All principal amounts have been paid back, bank account has been closed. My bank worked very nicely with me. Returned monies to me. Actually no one has called in a month demanding money. I am the one that is trying to get Ameriloan to pay back the excess and they keep avoiding the issue. BBB will close the complaint, I'm sure.

Here is the latest from BBB re: my complaints. I am so sick and tired of hearing about "Tribal Immunity". How despicable(sp) can one get.

Thank you for your email regarding your complaint. I have reviewed your case and looked at the response given by this company. Regarding their response about a specific complaint, I am not sure what they mean. It would appear to me that you explained yourself very well. Unfortunately, this company does not have a good rating with the BBB. They are an Indian tribe and therefore have Tribal Immunity. You can go ahead and submit your response to this complaint. If the BBB ends up closing it as ???Unresolved???, which if you look at their Reliability Report, you can see we also have a history of this being the case, you may choose legal action if you would like. However, the BBB is not allowed to give legal advice.
