Dear Hevnly:
Thank you for contacting the Better Business Bureau. We have carefully reviewed your correspondence; unfortunately, the issues that you have raised are not within the scope of services that we offer to the community.
Upon receipt of a consumer complaint or equivalent correspondence, the BBB makes an initial determination as to the dispute's eligibility for case handling. Certain disputes fall outside of the Bureau's scope of activity. In general, we do not handle claims of the following nature: (1) complaints against government agencies; (2) landlord-tenant disputes; (3) employer-employee or labor disputes; (4) claims involving the competency of professionals (e.g., attorneys, physicians, dentists, accountants); (5) complaints against individuals, rather than businesses; (6) disputes involving consequential damages; (7) claims alleging discrimination; or (8) disputes which have previously been addressed by a court or are in the process of being litigated.
In addition, the Bureau does not provide legal advice or legal services, make collection of wages or debts, or provide credit information. The BBB does not pass judgment on the price charged for merchandise, the quality of services or workmanship, or the length of time merchandise should wear or last, unless misrepresentation is involved. This list is NOT INTENDED AS A COMPLETE LIST OF ALL INELIGIBLE MATTERS, but rather is intended to offer you basic guidance as to the general scope of our activity for your future reference. While we are able to successfully resolve the majority of disputes brought to our attention, we are not an enforcement agency (and thus cannot force a business to comply with your wishes) and are not the appropriate forum for certain matters in dispute.
The BBB does provide pre-purchase information, conducts mediation and arbitration of complaints, and investigates – and seeks to eliminate – misleading and deceptive advertising and selling practices.
In your case, the issues you raise are of the following nature:
(12) Legal matter requiring advice
Unfortunately, such issues are not within our scope and inappropriate for our services. This does not minimize the importance of your concerns, nor is it any reflection upon the validity of your dispute.
While we are unable to handle this matter, you may wish to contact the following agency/organization for assistance with your dispute:
• New York Attorney General / Address: The Capitol, Albany, NY, 12224-0341 / Phone No: (518) 474-7330 / Web Site: www.oag.state.ny.us
The AG’s office is separated into the Criminal Division, the Division of Public Advocacy, the Division of State Counsel, the Division of Appeals and Opinions, along with several other bureaus. The Office needs complaints in writing, either using their form or a letter. Forms are available online. For consumer type complaints, they offer a mediation service if we believe our intervention might assist in resolving disputes. There is an executive office also located in New York City at 120 Broadway, New York City, NY 10271, (212) 416-8000. Consumer Helpline: 1-800-771-7755.
As the nature of your complaint appears to be involve a legal matter, we suggest you contact an attorney to advise you. We recommend that you contact your local bar association if you require a referral.
We do not handle complaints involving illegal behavior.
Thank you for thinking of the Better Business Bureau. We hope that we may provide you with assistance in the future.
Sincerely,
Jihan Varisco

hevnly, what did you say on your complaint? I'm curious because their reason for not helping is "legal matter requiring advice". I sent all my complaints in to the BBB and my pdls were all illegal. I never got a response like this. Do you mind letting me know what your complaint said?

You still have other options including the Attorney General. The good news is that the debt is not collectable as it was done illegally.

That's true, frog. I believe hevnly filed with the AG (I think?). But, I just find it odd that the BBB responded this way. I got satisfaction just by them contacting the pdls, even if it didn't get me anywhere! I wanted someone to harrass them like they were harrassing me! LOL!

Ok here is what I sent them... and I have not filed with my AG yet.
Internet Payday Loan taken from Interim Cash Loan taken 05/18/07 for $250. Starting in December I had sent numerous emails to them asking them to send me the form so I could pay them off. I received no form no email no phone no nothing. I made phone calls to them and kept getting hung up on. This continued until this past March when I started my own investigation against this company only to find out that they are un-licensed in Michigan and completely violated michigan's law. Up until March 21, 2008 I paid this company $40 very 2 weeks which adds up to about $980 just in fees, and giving me no opportunity to pay them off like I wanted too months ago. On March 24, 2008 I sent this company a Cease and Desist letter that basically stated Michigan laws and how they violated them, how they un-licensed in Michigan, that I closed my bank account and they were to only communicate with me via email or certified mail, no phone contact would be permitted. I also stated that they mark my account paid in full and send me a refund of $690. I have received numerous threatening calls to my home and workplace, and they continue to send me payment notification emails. I do not have any account ifo on my loan with them because it is impossible to contact them and at this point I consider this matter closed as they have received more money from me than allowed by law.
Your Desired Resolution:
The settlement I am looking for is my account with Interim Cash to be marked paid in full. I would like the harassing calls at my workplace to stop. I would also like a refund in the amount of $690 meaning I paid them $290 which is the amount of the loan plus the $40 fee. Michigan law states that a loan can ONLY be renewed if it DOES NOT charge a fee.
I found the BBB varies greatly from state agency to stae agency.

I guess this response doesnt bother me too much. The only thing they can do is send me to an illegal CA or put me on "their" credit bureau right?

hevnly, the BBB was probably focusing on the harrassment you received from the pdl, etc. I was a lot shorter and to the point. Just the facts - period. However, it's okay if they decided they don't want to assist you. I just personally like the BBB to contact these friggin pdls and have them respond. I've had many complaints that the BBB closed. I figured "whatever". I would file again. LOL! But, I'm a hound like that. Please file with your state AG. Also, file with the FTC. You really need to file with your state AG. Most will start sending out letters to the pdl on your behalf.

How do I go about contacting them? Im also going to file again with the BBB without the harassment stuff.

hevnly, when I was trying to find my state AG info, I just "googled" my state attorney general and the site came up. On there was something about consumer protection. I went into that. Then it had a link to file a complaint. In my state, I had to download the form, print it out, fill it out, and mail two copies back to them. However, some states, you can file your AG complaint right on line. And, go ahead and file a complaint with the BBB again. What do you have to lose? Nothing. Just tell them such and such company is illegal in your state, you borrowed xxx amount, you repaid xxx amount, and you want a refund for xxx amount. Just be straight to the point. Maybe at least they will see that you're just asking for a refund of an overpayment and take it on.

I found my AG complaint website, should I make it short and sweet with them as well? Or keep my origianl complaint I used for the BBB?

I basically got the same BS from the BBB in the jurisdiction for UFC. I filed twice.....same nonsense. Didn't bother a third time. As for the AG's office, I am not sure what to make of that. It would appear that AG Cuomo Office has their hands full elsewhere. I keep on sending complaints to them, naming names, asking for help, but to no avail. Perhaps I am not giving it enough time but since I've settled 3 out of 5, I will probably get through this before they even contact me. I am about to send them another letter giving them more recent info, so I guess I will wait and see what happens there. Don't lose hope.....keep on keeping on.

hevnly, with your AG, just give the facts. The pdl, the fact that they are unlicensed/illegal to lend, the dollar amounts, the debits, the dates, anything you have. Give as much information as possible, but be very straight forward regarding facts. I did a "summary" sheet on all of my pdls. I had the amounts, the dates, everything. So when I filed with the AG, I just included the summary sheet showing the amount borrowed, what was debited, etc. Also, pointing out the fact that the creeps were unlicensed/illegal to lend. I didn't go into any harrassment detail or anything like that. Just the facts. Let them focus on that.

hevnly I also sent a complaint to the BBB on Interim Cash, but have not heard back from them as of yet. How long did it take to get a response from them? I had the same thing happen to me with them, had a $200 loan and paid well over $1000 and couldn't get them to pay it off, or got hung up on. Should I send a complaint to the NY AG? The only thing is Interim Cash is not physically located in the US, what do you think.

kolodin...I filed with the NY AG as well and like I said, haven't heard a thing. Could be a lead time factor...I'm just an impatient person! I am however, in the process of sending yet another letter to them on my friends at UFC and enclosing more written documentation, taken directly from their site. It never hurts to file a complaint where ever you can on these yahoos.

I received this letter back from the BBB about 4-5 days after I submitted my complaint. Most of the other complaints I filed on the other PDL's I just got back a confirmation from the BBB with a deadline for the company to respond. And those deadlines are within the next week so we will see what happens.
