I have a loan out with BigSky Cash. I have sent them the standard letter stating that they are illegal in New Mexico. I sent another letter restating this when the phone calls kept coming. I then got a response from a Kathy Parks in a very non-professional, undated letter stating she understands that ???making loan payments is not always the top priority for people in financially stressed situations. However, the State of New Mexico does not have jurisdiction over our lending practices as you stated in your fax.??? I didn???t fax these letters, I mailed them. She goes on to state ???We operate legally under the laws of the Sioux Nation. This was stated clearly in the loan documents you signed ... You were provided a printable copy at the time you signed, but I have attached another copy for you to review. I have also attached a copy of the balance and payment history on this account.??? Blah, Blah, Blah She gives a contact number to reach her and says they would be willing to take small bi-weekly payments to begin paying this loan off. Collection efforts will continue until this account is paid. Says I must notify their office within 30 days after receiving the notice that I dispute the validity of the debt or any portion thereof or the office will assume the debt is valid. (didn???t I dispute the claim in the original 2 letters???) This communication was from the workout department. It???s an attempt to collect a debt, etc., etc.
The GOVERNING LAW paragraph (that she kindly highlighted) on the contract states: "This Loan Agreement is governed by the Indian Commerce Clause of the Constitution of the United States of America and the laws of the Cheyenne River Sioux Tribe. This Loan Agreement is not consummated until your loan is funded by us from our account in South Dakota, and your loan is repayable to that same account in South Dakota. We do not have a presence in the State of South Dakota or any other State. None of this loan, the Loan Agreement, nor Lender, is subject to the laws of any State of the United States of America.???
My questions are:
Can they really do that? Of course I didn???t read the fine print when I took out the loan.
What action do I take now?
This is so stressful. I do feel like I???m making progress with the mess I???ve made, but this is a duzy!

heres the thing, i work for a pd loan company and i agree with the fact you dont want to pay all of that money in interest but what you people dont understand is that this is a PAY DAY LOAN. if youre trying to take the money out for personal use and intend on making payments your in for a world of hurt,. they were invented for the sole fact to take it out, pay a ONE TIME FEE and be paid off on your next PAY DAY. if you extend it out, youre accruing interest, and that is not something we ever encourage at our company. we do everything here we can do, verbal, and SEVERAL written set of terms but you guys just want the money so bad you take it and sign without understanding.

In the end its no ones fault but your own. You took the money, and didnt pay it when you were obligated to. its just like a credit card or any other defaulted loan. you owe the money plain and simple. Dont borrow SHORT TERM money for a LONG TERM problem.

To PDl and I know more Noone on here is telling anyone not to pay the money back, it was borrowed it has to be paid back. If you read through the threads in here people are always told what they have to pay back. The problem comes up when the amounts have been paid back and the pdl companies keep coming and coming with lies and threats. If 1000 has been paid on a 300 loan, guess what it's paid.

they are trying to get their land and money they feel they are owed but using the laws of the us goverment to setup businesses that do not fall under the laws of america. never do business with them

Sally D, I think Big Sky Cash is also Great Sky. I had a PDL with Great Sky and I received a refund from them with very little trouble. Once I filed the complaint with the AG in my state AZ, and emailed a copy to them, I had response within the same day. Maybe you need to send copies of all of your documentation to them?

I am responding to this person giving advise. Rest assured that these Indians are covered under their laws. I found out the hard way and ended up paying a huge price by listening to other people.:mad:

Then you didn't go about it the right way, while these tribes may be exempt from our laws, we are exempt from theirs also.

shazz the person above you is a shill.nothing more.i will still tell people that any "tribal loan"is illegal and that they only owe the principle,and there is nothing that can be done about it.it does get redundant though.the same plain posts stating how these places can do what they want.(yawn).

The representatives I spoke to Kelsey and Bee have been very courteous every time I call and ask questions. Kelsey even explained to me exactly what I was getting in to when I took out this loan. I understood how these loans work and the interest is high but at the time I needed the money. I have even referred friends to them. One had a financial burden and had to file debt consolidation, she spoke to Kathy Parks who was kind as well, she explained that even though her state does not allow pay day loans that the contract she signed was valid. They even settled with her and offered great payment arrangements. I have no idea why you people complain when this company was there for you when you needed it. If the loan was illegal when you took it, then did you as well not break the law as well? Hate the double edged sword? Do not complain about kind people who helped me out in a few hard times. If you have no intention on paying a loan back do not take it out! You are only putting yourself in further debt, then come online and complain and want people to pity you.Grow up![/FONT][/FONT]
