Bank of America Claim/ Payday loan NY

I live in the state of NY , and thanks to this forum recently found out that such loans are illegal in the state .I currently have seven payday loans and have put a stop payment on all of them. I filed a claim with Bank of America, I got the Affadavit form today and they're only filing for $250 dollars . I think they misunderstood me , I would like for them to file for all the money I paid to these lender since they're illegal.

I sent the payday loans a template of the letter that I found on this forum.

What should I do ??


Ironically, I tried the very same thing you are trying to do through BofA (though I live in CA). While the ACH block was instituted fine (and has continued to work), my claims for restitution of the illegal fees levied upon my by the two online PDLs I disputed were denied because, though electronically "signing" the agreement (illegal or not), I authorized the vendor to deduct the fees and BofA will only reverse the fees if the vendor agrees to the restitution.

It seems the only other recourse to try to get the illegal fees back is via civil means.


On the bright side, at least I'm not getting raped of illegal/excessive fees every two weeks any longer - and it seems the online PDL vendors have "gone away." (Even if they try to call and harass me, I have plenty of ammunition to throw back at them). So, at least THAT part of the battle has been won.


Nevertheless, if you are more successful with your BofA claim, let me know what you did. I would LOVE to get back the $1400+ in illegal/excessive fees this one online PDL took from me over a 10 month period.

I'll let you know what's the outcome, I revoked all ACH on 06/16 .
Today I got a call from a rep for One Click cash basically forcing me to give my debit or credti card info to make payment arrangements.

Then later in the day I got a call from VIP cash about my account .
I didn't answer either call and they both left me voicemail messages .
