Hey guys.. ok here is a question I need to ask. I wrote to Jackson Phillips, and ARMS requesting the validation of debt , and after the 30 days if they don't respond to me, then what ?

I am sure someone has covered this somewhere but I thought I would ask.

Thanks!!!!!!!!

yes , they are collecting from internet pdls.

I havent received any usps mail from either collection company nor internet pdls, I have not recieved any emails, I just get those BS calls at work about downloadings (LOL!) and such... so.. I have filed complaints with NC & FL AG, and the whole shebang..
So I just wonder after 30 days.. what more can be done? Can I legally be null and void to them or face amusingly more downloading calls?? LOL!!!!

Lorim-Cannr sent a CA a DV letter, they never validated and then they just removed it from her credit. Definitely follow up and then send your DV notices to the bureaus too if they dont validate after the second time.

Morning-I have heard both sides on that....good point. I dont think its in the fdcpa that they have to validate in 30 days or null and void, but I honestly am not sure how much time they really have...? I wish it was that way :P

M-O-O-N. that spells DUH...

thanks .. if it were a snake it would have bit me for sure...

I don't think those losers are going to hit my credit report. I do seriously doubt that. *knock on wood*

I did mention to Jackson in my validation letter, how I reported them and their illegal tactics, their false representation of attys ,and though I knew the collectors names were phoney, I still told them I named them indvidually out in the complaint to the NC & Fl ags and to the FTC.

so I figure,am letting them know that I know they are illegal and their fly by night operations are not flying on me.
so.... but I still want that "validation" in the event I need it.

well as far as I can tell no they havent reported to the credit bureaus. I don't think they can. They are as illegal as the sky is blue.

I just think it is too funny, that can call my work and harass me they way they do, and not send me a letter nor an email or anything showing I even owe these internet PDLs $$$, I have one (1) thing sent through email , and it wasnt even a contract, just something stating amount, due date, finance charge. I have not a contract, or anything. Yea I owe for 2 but got 3 somehow, and no paper trail or recourse to even go by.. the PDL's never even contacted me phone-email-usps mail when their loans were defaulted...and when I tried to figure out who I even owed with the aka's and dba's-- I found this site, and found out it was illegal in NC for pdls in the first place...

sooooo .....................
I was just denied credit so I can get my free credit report... I will be looking at it and keeping my eyes on it..........

thanks guys!!!!!!!!!!!!
I am going to find that follow DV and have it ready!!

well I pulled my credit report. and nope nothing. I did see something that I question the SOL on .. in NC promissory notes have a SOL of 5 years. The 1st date of deliquency was 9/2001 which is about right.. the date of assigned was 4/06, the date reported was 8/07. date of last activity - says -"unknown"

but here is what I know I dont understand , equifax states all collections, are on for 7 yrs...

what do you think ? I am going to post this in collections too.. but thought you guys might know.

Oh just so u understand: If u send money it does indeed start the SOL again!! Some states even if u admit to owing the debt can restart SOL! A DV letter will not, or should not re-start it.
Now i'm wondering about it. I dont' wanna give u the wrong information!! I never thought a dv letter would re-start SOL cuz ur asking them to prove they own this debt!
I'll ask and let u know soon,
Ang

lori, don't assume these collectors that are trying to collect on an illegal debt will not hit your credit report. I thought the same thing. Guess what. One was there. Collecting for an illegal overpaid refunded pdl. On my credit report! Please don't think that because the debt is illegal that they won't hit your report. I am living proof that - yes, they can.

I agree Cannr, that is why I went ahead and pulled my report, but it isnt there, so far so good.
but I did have a check n go on there from years ago (less than 7 yrs) and it is finally off after yr or so disputing it, but I have noticed what gets taken off of one, sometimes gets put on another, for example, what gets taken off of Experian will end up on Trans... or Equifax.. have you or anyone seen that kind of pattern?

Yes, unfortunately. One report will have something on it, the others won't. It's really kind of weird. I'm like "whatever". I just tried to take care of all 3. They all don't "match". It's good you pulled your reports. I'd give it some time & pull it again. No telling what these illegal idiots will do months from now!

OK well I got a letter in the mail from Accounts Receivable Management of Florida....

AND

a copy of the " Short-Term Consumer-Loan Note and Disclosure Statement"

you know what caught my eye first? ( amongst other things) the 497.73% apr on this "loan". It is from G R Enterprises ( never heard of them) and it has my name, bank info, and it is signed :"Signed Electronically" (now that isnt my name now is it?)

LOL!
and the letter says " blah blah blah......(the usual) then says you have 30 days to dispute the validity of this debt...blah blah blah"

I thought you morons.. did I not just send this to you in the first place?

so.. I guess I should just copy off another letter (actually the same one I originally sent) and send it off AGAIN...
we can play "let validate this debt" forever at this rate.

LOL!

I still havent heard from my buddies at Jackson Phillips.. *knock on wood*.
