i have a few payday loans and cann't keep up wth them what should i do


I recognize two of those names--Ameriloan and Northway Financial, which I know are internet payday loans. The good news for you, my friend, is that Northway Financial has been banned in the State of California! They are part of the Sonic family of companies, (Sonic, Cash Transfer Centers and Northway Financial) which have been banned for some time.
These companies are infamous for having you sign a form which allows them to garnish your wages should you default. What I want you to do your next day at work, and I mean your NEXT day at work is to contact your payroll person and revoke this authorization in writing. I promise you, as soon as they catch wind of your trying to end the relationship, they will try and collect. They tried with me, I know.
The other thing you need to do is close your bank account immediately, get a new one and do NOT give out the number. This is the only way you will get control back over your money.
How much have you borrowed, and more importantly, how much have you actually paid these people, counting all rollover fees?

Oh thanks Shazzers.... I'm still a little in the dark tho. Have a loan with united cash loans for $250.00 opened on 6/24/2009, paid $75.00 4 times on it then a $50 and a $60 (I guess the fifty to start to pay down loan) (also have all the dates of those withdrawls) So in reality, have I over paid them by $160.00? If I could have help with understanding the other 3 I will be happy to let you know what they are. Need help... this is making me sooo crazy!!!!!

I haev several internet PDL's and live in california. I am losing control of everything. How can I stop them from withdrawing ACH from my checking account. I am in no way saying I dont owe them the principle amount but I just found out they are illegal in california. one of them I have over paid the principal by $300 and they say I still owe 637. If I close my bank account can the bank get angry with me. I know if I send them the Stop Ach with draw that they can and will try to withdraw the money. Is this considered illegal in california if I submit in writing that they can no longer withdraw from my account, and a revoke of wage assingment? How do I protect myself? I am not trying to get out of paying them.

Well, if those are all illegal than all you would pay them is the principal amount you borrowed, if you over paid them then they owe you a refund.

I just spoke with a person at the California Corporations Commissioner and was advised I am in trouble because I have 2 internet payday loans from UnitedCashLoans and OneClickCash, he stated that since they are immune from California state laws because they are a Indian Tribe. Does this mean they are considered legal. I am so confused here. Its driving me insane. Is this true... Are they considered legal? How do I handle them now. Please help I am the verg a meltdown.

they are immune from state laws.not just california.however that doesn't mean they are legal.no,no,no.they can't do a thing to you.if they want their immunity they can't step off of tribal ground,but really.most of these employees are as much native american as you and i.ask your AG(attorney general) their take on this,and they will echo what i said.just because they have tribal immunity doesn't make them legal.

So should I stick to my plan and close my account, and send the revoke letters for ACH and wage garnishment. and send them letters stating they are illegal and i will only pay them back the principal amount? and wait for the harrassament. God I am falling apart. this is so scarey. I agree i owe them but one of them I have paid them 905 on a 500 loan....My life is falling in a hole. Should I not fear the Tribal one's.

You will be fine! You are immune to THEIR laws also, keep that in mind.

I have been called repeatedly at work by two payday loan companies. These companies kept hitting our bank account until we owed so much in insufficient fund fees that we had to close the accounts and make a settlement with the bank. Now we can't even have a checking account at that bank until our settlement loan is paid. Just today I recieved a "settlement offer" from one of them:

I asked them to send me the payment history but they refused (I believe I have paid at least $300 in what they refer to as "interest"). The other loan is the same thing although they have told me that I have paid $315 in "Fees" to that company: Payday loan yes. They also tell me I owe them a total of $650 due to the overdraft fees the bank charged them. Do I have any recourse? I have read the previous posts but still don't know how I should proceed at this point.:confused:

Thank you for all your help. I have sat down and written out a plan. I have my letters to revoke ACH and Wage garnishment. My plan is to go to the bank and close my account. Hopefully the Bank (Wells Fargo) will understand my issue. Then once my account (possible 2 accounts since I have a joint one with my mom and not sure if they ever had that information be, since I dont want them going after a past account) are closed I will then fax, e-mail and cert mail letters to all 4 telling them the situation and the amount I truely owe and a cease and dissit letter to not call my work or home and only communitcate through US mail, and wait for them to FLIP OUT!!! Oh and also sent a revoke of wage garnishment to my HR Dept. I do not tell the PDL's anything till everything is done first correct? I also write complaints to the Attorney General Office, Californ. Corp, and BBB. Can someone tell me if I am missing anything here? I know they are not going to go by the laws, especially since 2 are Tibal Immune, but I guess this is what I have done to myself and now I must accept the punishment. For some reason my reply???s are not showing up. So if I sound stupid bare with me.
My plan is to go close my accounts before my next pay date. I have 2 one alone and one I shared, I don???t think they have any information on the shared account but I am too scared to find out the hard way. So after accounts are closed and HR Depart. Has my Revoke wage garnishment, I then cert. mail, fax, and e-mail letters telling them my accounts are closed, I revoke my ACH and wage garnishment and that they are no longer allowed to communicate through my work or home and I will only accept us mail. I will then state they are illegal in California and I also found the orders to cease and desist orders and I will attach them, and that I will be only paying them back the principal amount minus any payments made. I will also file complaints with BBB, AG and Cali. Corp. Am I leaving anything out? Can anyone see any mistakes here? And I want to make sure I can not go to jail for any of this? Thank you for all your knowledge.

ok i am really scared, I need to know if anyone has dealed with Citibank and closing a account to stop ACH withdraws. I am going to going and see the one lady there I know, but I am truely affraid she wont understand my issue, I am taking in my letters of revoke and also the information I printed from the Calif Corps website , I really want to make sure they wont prosecute me. I have proof that I have made payments to these people and also information that they are not legal and that as far as I know in Calif. I have the right to revoke ACH withdraw. I just need some support, my stomach is sick all the time. I have been with them since 1999 and dont want to leave the bank I just want to shut down an account.... UGH !!!!! any information will help.

First off, noone is stupid here, OK? You could say we all were stupid for getting payday loans in the first place, but we all got smart when we saw how much they were costing us.
You should have no problem dealing with Wells Fargo, as that is the bank I dealt with when I was first getting out of PDL's and they were actually quite good about closing my account and getting me another one. You do need to tell them that there is fraud going on, however.
And when it comes to PDL's on tribal reservations, I would think that in order for them to get a license in California they would have to abide by certain rules, yes? So that would mean that they don't have to get a license and are free to do this criminal behavior?
