They have been calling me non-stop. Called at 6:30 am this morning. They stated that I had an arrangement to pay 390 last week (no arrangement, just them sending me a letter saying they'd accept that amount). I hadn't spoken to them at all. They are saying they're with Receivable Management.

She stated they were going to call my employer, verify my wages and garnish my wages today. Can that be done?

How should I handle?

Did you revoke the wage assginment in your original letter to them? If you did make sure you give a copy of it to your HR department. If you did not just right up one and send it to emeral as well as your HR department. Make sure you file complaints against emerald with the FTC your state AG and depending on which state you are in file a complaint with the regulating agency that deals with payday lenders.

they can't garnish without a court order.they are reffering to that very wage assignment.emerald is an out of the country piece of pdl garbage.do a search in the bar top right.it will give you more insight on emerald.just know they can't do what they threaten.last thing i don't know of any employer that will verify anything over the phone so do as tousi76 advised.draft a revocation letter and give it to hr/payroll person before submitting to emerald.then they are powerless.

Okay I just called my payroll department regarding possible wage garnishment. He stated that of course they have to go to court but if the judge issues a garnishment, they have to honor it. I explained that they are an illegal loan company.

He told me that if something comes across his desk, he'd let me know. I am also going to give letter to HR and give them a heads up to cover all bases.

Be sure to give a copy of your revocation to your employer. Also, let the gentlement in your HR department know that you had signed a "voluntary" wage assignment and that you are revoking it and providing him with a copy of that revocation.

If they send anything, he'll be prepared.

Also, let him know that there won't be anything coming from a judge because, as an illegal lender, they can't take you to court.
