I live in Arizona and I received two payday loans last year, one from Bayside Loans and the other from Peppertree, they just called me and are serving me with court papers. They said that since I defaulted on my loans the lenders are looking to file criminal court charges. They said that I have until the end of June to pay them $700 or I will face criminal charges. I explained to them that I had lost my job and there was not much I could do but I am working now and able to pay the loans back. They said they will not file cease and decist papers with the court until they receive the money. I explained to them that charging me with felonies would impact my job and they did not care. How am I supposed to pay them back if I am not able to work because of 2 felony charges. Can they charge me with these felonies?

They are not serving you with court papers. They're full of it. They're trying to scare you into giving them your money and it sounds like it's working.

Don't let it :)

Payday loans are illegal in AZ. Small loan rate cap is 36% APR with a 5% fee. Small loan lenders must be licensed.

Neither of these lenders are licensed and I'm betting they charged you WAY above that 36% rate.

Tell them to go ahead and serve you. Tell them they can meet you at your local police department to do so.

Report these collectors to the FTC and your state's AG.

i loathe stupid bottomfeeders.the terms they throw out are hilarious.for one the terms is dismiss,or drop the charges.the cease and desist makes me laugh, and cringe at the same time.as the two experts above me posted they are full of it.file complaints and stay off the phone.btw a class 4 felony is like a murder charge.they broke the law themselves.report and ignore.
