Hi, I had a Payday Loan from Cash Advance Network from Oct in the amount of 200. I paid 120 in Dec, and then in Jan I didn't pay anything.
Well I got a call from a collections agency saying I owe them 365. I was scared because the lady kept saying she was going to record the conversation with me saying I wouldn't pay, so I gave her my account information to withdraw $50 in two weeks, then $125 two weeks after, then the rest two weeks after that.
Well after research I found out that in the state of California, they weren't allowed to charge that much, AND I had already paid two 60 payments. They said those were rollover fees. I told her state law prevents that. She said internet law supercedes state law. And that the conversation was being recorded. I told her she did not have my consent to record the conversation. She said then hang up the phone. I said it was illegal to record a conversation without both parties consent. She said no it wasn't. I told her I would call back and record my own conversation, and she said not in my office.
I requested proof of debt and a physical address to mail her a letter and a payment. She said you aren't mailing me anything, and was yelling at me the whole time! She kept saying I signed a legal binding contract and spent the money already. I said I'm not saying I don't owe, I'm saying I already paid half of what I owe and I don't owe that much. She said if I withdraw authorization to electronically withdraw payment she is going to mark my account as refusal to pay.
That's basically how the conversation ended.
Am I really in the right? Does "internet law" (whatever that is) go over state law?

hey!! this is not at all right that there is any law (internet!! ha! ha!! what a fun!) which supersedes the states law.

Now coming back to the payment issue.This is really an illegal to record the conversation without the second party consent.and you are right on your stance,

Never pay any late payment fee, because they are not supposed to charge it.

Finally hats off to the internet law trick !! i am still laughing!!!! :wink:

i sent a c&d letter to arm of florida, so far they havent been calling me, i also know for a fact california is a non consent state and recording calls is illegal, i work in a call center and every call center has a QA department, when a cali account comes up they are not allowed to monitor the call let alone record it.

So they just called my work. I told them they didn't have my permission to contact me here, and to only call me on my cell. She said, "don't be difficult." Then I asked her if the call was being recorded, and she said, "Of course" and I hung up on her.
She called me 4 times in a 6 minute time span. Then she asked for my manager or for anyone in payroll. I said no you can't speak to anyone in payroll. Then she called back just asking for a manager. I put her on hold and told my manager what was going on. She picked up the phone and was yelled at to give her name. She said very calmly, ma'am please take a deep breath and let's talk professionally. She yelled, Don't tell me how to talk to you! So my manager hung up the phone. Then a Kate from ARM called wanting my attorney information. I told them that I have two witnesses that I told them NOT to contact me at work or to record my phone calls. Also I kept asking them for a physical address to mail a money order, and she said no I'm not giving you one. I said, "you are refusing my payment then." And she said yes!! I haven't received a phone call from them yet. But that was all 3 hours ago!!!!!

Since there are several posts by different people I need clarification. Is ARM collecting for CAN? CAN is an illegal pdl and ARM of Fl is a bottome feeder CA. Dont give these people any money. The next time they call you ask them for their license # to collect in your state and tell them CAN is an illegal unlicensed PDL company. Tell them you are recording their call for your AG's office. File a complaint with the BBB about ARM of FL, they were very helpful in helping me get my account closed.

Yeah I filed a complaint with the FL BBB last night. This was before the harrassment at work this morning. I sent them the template letter by email, that I got off the BBB website, and they also have a physical address. So I'm going to send the same letter by certified mail, with Return Reciept Request. Also, they are doing this all over a $200 loan, that I've already paid $120 on! I keep asking where to send the money order and they keep threatening me with legal action. I don't get it.
I've just contacted the law offices of Weisberg and Meyers. I was willing to let harassment at home go, but not when they harass me at work, AND harass my manager!

arm collects for can and paychecktoday, the c&d letter i sent really helped, but i filed a complaint with the bbb of fl too and the response i got was pretty much worthless. arm responded with the 5 page letter talking about how they investigated the issues blah blah blah, stated they will not close my account and will not issue an appology but they will leave my account in a c&d status. i have 10 days to dispute it or the bbb will consider the matter closed. they said it doesnt matter if can is licensed in my state or not because it was done over the internet and my state laws dont apply. but they did not mention anything about not being licensed to collect in my state, then they responded saying the only hire the most professional people who indure many test to make sure they are qualified. all in all it was a waist of time. i can keep on disputing it but it doesnt seem to make a whole lot of diffrence to me. as long as they leave it under the cease and desist then i guess they are not doing any damage anymore.
