As many of you know, I have been battling with Cash Call over a loan originated by Western Sky since August of 2012. After months and months of researching and reaching out to agencies and attorneys, I have finally located a reputable attorney who is gearing up to take this on as a class action suit. I have put many of you in touch with him already, but I know just from reading the posts daily that there are still LOTS of you victims out there. I have fought long and hard to get to this point and I want to make sure EVERY victim of this "scam" on this site looking for answers has the opportunity to seek justice, and hopefully at the end of the day restore their credit reports and their sanity. For ethical reasons, I cannot blast the firm name and number on the site, but I can provide it to you if you wish to have it through a PM or personal email. The larger the number of us, the better chance we all have, especially those of us who live in states where consumer protection is not a priority.


I am desperate for help with them! I'm beginning my struggle with them today. 12 calls just today. $2500 loan and if you subtract what I've already paid, I owe them $1600 still. Not sure how to address it with them yet. Trying to send my cease and desist letter. They make me very nervous!!

No disrespect to anonymous but for those that might not be aware of the history here there have been tons of complaints filed with FTC, Consumer Protection Bureau, State Attorney Generals etc. A few states have filed things like cease and desist orders which the companies mostly choose to ignore.

It's going to take more court cases from private individuals such as hear to bolster the efforts of the states.

Some of the agencies (states in particular) have limited staff and resources and seem to not want to challenge the whole tribal sovereignty status on their own. Private involvement is going to be essential in bringing down both the "tribal lending' and "offshore lending" models.

The Consumer Finance Protection Bureau, which congress established after the mortgage fiasco is starting to look at these also but being a government agency they act very slowly.

diggerg - I guess I missed the "annonymous" post but you are absolutely right. This is why I have been working behind the scene to put this all in motion. It is just frustrating to me how I read so many posts on these boards complaining and asking for advice on dealing with WS/CC but then they don't want to do anything about it (i.e., fight back). It seems they are complacent to just wait for someone else to do the work for them. Even though I have done the work putting the wheels in motion, when I ask people to join the fight, they would rather just watch from the sidelines but in the meantime will continue to belly ache about their credit reports. I will get off my soap box now....lol. But, for those that are serious about resolving their issues with WS/CC, they can contact me and I will get them on board. Thanks for your support!

Yes - there is a lot that I cannot say on the public boards for ethical reasons but I can tell you I did sign off on the initial complaint to be filed last week. They will not be listing everyone until they have class certification. There are a lot of pieces working behind the scene and some VERY, VERY BIG information came out that will blow them out of the water.

Im watching tv and commercial comes on call western sky problem solver loan. Problem solved!! Oh how I wish I could reply to this one. Hopefully that reply is coming soon. Just needed to share my thoughts.

To share what vaboy12 is talking about - to make it easier to find..... "I am currently employed at CashCall right now as a collector. Although, They are not a collection agency...the collections department is approx. 500 strong and growing. This is the most illegal collection department that i have ever worked for. I have met people who have worked for Shekinah and NCO who now work at CashCall, and they say we are 10 times more illegal. Everyday it is hilarious hearing not just one but all collectors telling 3rd party's or whoever answers the line that they are from the sheriff's, attorney's, legal department, fraud department, court house, and investigation department. They threaten suit, garnishments, actually anything they can think of. The crazy part about it is that all the management knows and they are ok with it. The motto there is "Do what you have to get the money". so whether you are 30-60-90 days late ...you will get these threats guaranteed. I don't consider these guys good collectors they are just total thugs. As a collector myself i never thought i would say this, but i feel bad for the debtor..96% interest. is that even legal.. If you are a customer with CashCall and you are late as little as 30 days...record the phone call,,,you will have an instant lawsuit. "
the company fails to provide copies of contracts or other disclosures concerning the terms and conditions of the loan agreements. Many customers complain that they are being charged userous interest rates in violation of the State law in which they reside. Other complainants report harrassment in the form of extreme or hardcore collection practices which they claim are unnecessasarily used. Customers report the company makes repeated calls to friends and co-workers used as references causing them embarrassment, distress, and jeopordizing their employment. Other complainants allege company representatives treat them like criminals, use threats and rude remarks concerning their families, and threaten them with physical contact if payments are not received.
The company responds to complaints by disputing the complainants allegations, claiming they act in accordance with all state and federal regulations. In some cases, they do issue credits. Allegations of abusive collection tactics are generally not addressed. "

I work for them. I know they are worried about lawsuits. Our company has allowed the reps and associates to harrass the *** out of you people. Now that there's changes being made because of the lawsuits all of the reps are being watched very closely. Im not trying to justify anything. Blame Louis Ochoa for letting this all go down. Our CUSTOMERS never should have treated this way. They deserve better. He did nothing while reps were harrassing customers and threatning the customers with lawsuits. Finally Paul Reddam steps in because he dosent want to pay anymore lawsuits from the customers. It's to late Reddam. Your employees hate working there because of people like Ochoa who they cant trust. You work them like slaves and treat them like dirt. And now you wonder why the customers feel harrased? Put that carrot out there that we work so hard for and now you act like you care about the customer? Never. He only cares about MONEY. On behalf of the GOOD employees who actually care about our customer, I appologize for what you have to go through. Record everything. Keep track of multiple calls. Always remember, there talk is cheap. They lie about everything."

Please don't let them eat you alive. It's just not worth it. I'll bet a bunch of states are going to start suing them now. Question: If the state takes them to court and wins, aren't most victims free from their stranglehold anyway, and don't they usually have to pay restitution? I thought that's what happened in WV.

There are many states, mine included, that refuses to touch the matter and are completely negligent in allowing these predatory lenders to operate. And, yes they still have a hold on you because they continue to trash the credit reports with these bogus loans and have yet to pay a dime in the restitution that has been ordered.
