Hi. I've been reading some old posts on here and have seen how helpful this community has been, so it's my last glimpse of hope, and i'm praying there's a chance to put an end to my problems. I like so many others have fallen into the vicious PDL circle and can't find a way out. I am an Idaho resident and my loans are online lenders. They are all in default because I ended up getting my hours cut and had other more important things like heat and housing bills to pay. I'm in over my head and was wondering if someone could give me some sort of insight or a little light at the end of this long, horrible tunnel.

these are the loans that i have...

CashNet USA-borrowed 750-say i owe 1127.50-paid 337.50

Oneclickcash-borrowed 200, paid about 255

unitedcashloans-borrowed 300, paid 270

payday1-borrowed 500, paid 485

cashstar group-borrowed 200, paid 385

cashcentral-DFS borrowed 300, paid 250

cash central, oneclickcash and cashnet usa are the only ones that really seem to hound me. I've tried to set up payment arrangements that i can afford, and have asked for direct addresses to mail them moneyorders, but they tell me its not enough and i have to pay from my checking account. I want to get out of this hell i'm in and do the right thing. can anyone help me and give me some tips on where to start and what to do? I'm desperate and any help would be so greatly appreciated!


I've been on here since March 16th. Like you I had many loans 11 to be exact. I've gotten a lot of good information from people who have been in my shoes or are currently in the same predicament. They will tell you the first thing you need to do is close your account or put a hard block on it to stop any ACH withdrawals.

You must then send a letter to each of the lenders revoking any wage assignment agreement you may have signed and give a copy to your payroll department. Wage assignments are not garnishments and can be legally revoked by the signer at anytime.

You need to find out which loans are legal and illegal in your state. The storefront ones usually are. I see that you have one with CashNetUSA which is legal in most states. You will have to make payment arrangements with them. The illegal ones if you have overpaid them you may request a refund.
The other ones that you still owe, you are only required to pay what you borrowed. If you already paid that then you owe them nothing.

To avoid harassing phone calls you may want to send C&D letters. This will stop the calls to your home or workplace if they have the number. They can only communicate with you via email & mail.

Hi there, I am in Idaho also. A few of yours aren't legal, right off the top of my head that would be: One Click Cash and United Cash Loans, those are the two I am certain aren't licensed to lend to Idaho residents. CLICK HERE to find out how to deal with illegal lenders. CLICK HERE to view your payday lender laws. Unfortunately, Idaho has little to no consumer protection for payday loans. I would advise you to take care of the legal ones first. In other words, make payment arrangements with them, as them if they have an extended payment plan in place. Unfortunately, you will need to close out your current account and open a new one, do not give your new info out to ANY lenders, offer to make payments with money orders via USPS. I know that CashNetUSA and payday one are legal lenders, I am not sure about the other ones but will need to check.

thank you so much for your help! i have been trying to deal with this all on my own for some time now. i actually started out with storefront loans and when i couldn't afford the interest on those i had to get online ones to keep my head above water. the worst thing is, i had NO idea that the stores would offer a payment plan to get rid of the loan and stop the interest. some of them i had for YEARS!!! one inparticular was a $400 loan, when i figured it out, i've had that loan since 2006 and have paid over $9000 in interest. it makes me sick and sad to know i could have saved myself from this situation so long ago had i any idea. now i'm on that long climb out of the hole day by day trying to take care of everything responsibly. just so overwhelming when my job decided to do cutbacks, thank god i still have a job though! i'm going to the bank tomorrow morning and closing my account...again. i switched accounts after this all started but had no idea about the illegal lenders so they have my new account information for payments. my question is they have my debit card, which i cancelled by the way, can they still debit my account if that is no longer valid since they had the number before it was cancelled? i just wanna get out of this mess reasonably and responsibly with some sense of sanity left. thanks again for all your help, i appreciate it so much

Just make sure that after your account has been closed it can't be forced back opened. I would talk to my branch manager about it, I would be honest and let them know you are dealing with some illegal lenders who may attempt to debit your account. Please make sure that you follow the steps in the link I gave you above "how to deal with illegal lenders". You want to make sure that you revoke their rights to debit your account, in writing (via email would work), print it out and show it to your branch manager. This is the EFT law and is perfectly legal. Make sure your account is closed and safe BEFORE you contact the illegal lenders. You could probably tell the legal ones you had no choice but to close your account due to illegal activity, I wouldn't even give the legal lenders your new account number, tell them you have no other way to make payments other than money orders.

thanks for letting me know to secure my account before i contact the illegal lenders. i'm hoping the legal ones will be easy to work with, as they're the ones that are constantly calling me. i got them to stop calling my work and references, but cash central for example will literally call every 2 to 3 minutes and they hang up as soon as i answer, then send me nasty emails saying they're efforts to contact me have gone ignored. i'm feeling better knowing that some of these are illegal and that for the most part i've paid what i owe them. unfortunately, the larger ones i owe on happen to be the legal ones, and they haven't been touched for a couple of months. i'll get on those tomorrow morning and get some sort of payment arrangements set up that are hopefully reasonable for what i can afford right now. i'm so glad i found this site, it's been a true blessing and you're all so helpful. its comforting to know i'm not alone.

any suggestions for how an email to the illegal lenders revoking their right to debit my account should be worded? i'm usually pretty good with words, but i want to make sure i do things appropriately and handle the situation well. i dont want to say anything that could come back to haunt me or word it incorrectly and have it blow up. thanks for any suggestions

closing the account tomorrow. i'm just worried about them having my debit card number being attached to that account. i have cancelled the card, but dont know if they can still pull money if the card is invalid. they dont have my checking account number but my visa debit card instead. is there anything in particular that i need to do since most the time its' talking about ACH withdrawls not debit cards

sent the emails to United Cash & One Click stating that i was revoking their right to debit my account, since the EFT act says it must be done in writing at least 3 days preceding the transaction. i'm sure i'll get some nasty responses, but gotta take the bad with the good in handling these situations. feeling a bit of the weight on my shoulders slowly start to disappear.

I called two of mine and they worked out easy payments for me. The people I talked to were really nice about it on the two. The third one gave me a problem until I sent that letter to them. Then they agreed on a payment plan. I guess the main reason being they were ILLEGAL.......but it all worked out.

i also set up payment plans with these companies, when i thought they were legal. now that i have found that they are illegally lending in my state, and i've already paid back the principal and then some in most cases, i need to something about it and put an end to them taking money they shouldn't be. this site has been great so glad it's available and that everyone has been very helpful

been at this since 8am, trying to get a good idea about what lies ahead for me. these loans have been in default since january and i've made payments on some of them, but with company cutbacks at work and a very cold idaho winter, those bills took first priority and i haven't been able to afford any payment plans. here's to hoping i can get one step ahead now instead of 2 steps back!

I admit this forum is VERY helpful and informative, but one thing about your plight seems clear to me. You are wasting more time and money paying off anything at this point, "legal" or illegal pdl. Admittedly, I was in a WORSE situation than you (15 pdl's, 6 credit cards, many out of pocket medical debts, etc.) which led me to filing bankruptcy. Don't get me wrong, I didn't want to persue a bankruptcy, but if I hadn't, I -- and more importantly, my family -- would have been swallowed whole by all these debts. If a person only has ONE of a FEW pdl's then the suggestions and tactics of this website will probably work fine for recovering, but I think it sound's like bankruptcy is the only way out for you. I'm assuming you have credit card and other debt as well. Bankruptcy doesn't seem to mentioned much on this website (and there might be other reasons for this), but sometimes, it's the ONLY true way out in order to stay the course, keep providing for your family, regain control of your finances and have a fresh start in managing your money better.

There is actually a whole forum dedicated to bankruptcy.

The problem with some of the internt PDLs is that they are illegal because they are not in the US. So even if you listed them on your bankruptcy they are not going to stop harrassing you as they are not going to follow the law.

They also are not discharged because they are in another country.

I have actually followed the advice and was able to utilze information from this payday loan forum before and now during my bankruptcy -- because payday lenders as a whole are indeed unbending, inflexible and relentless!! About half of mine were based in UTAH and NEVADA. Cash Transfer Center was in Malta, however. You have me wondering about that one. I will ask my attorney.....

i do have other debts, but i believe in taking the responsibility to pay them off, since i incured these debts on my own free will. i made the classic mistakes a lot of people do in going into debt, and i'm not saying anything bad about bankruptcy or you choosing to file it, i just dont think it's someone else's responsibility to bail me out for my own poor judgements. i'm using this forum to get tips, advice and a bit of support when dealing with this on my own. thanks for your input though, i'm glad you were able to get yourself out of a scary situation, best of luck to you teddy grahamz

i got my checking account taken care of. the bank i work with is great and have been so helpful during all of this. thank god for one good thing. got an email from one of the illegal pdls about an hour after i sent them the notice to revoke ach rights. offering me a chance to keep my borrowing options open, to settle for a lesser amount (5 dollars off what they say i owe them lol). feelin a bit better about things now...except found out i have to pay taxes this year instead of getting a return, always something to knock ya back down

Good to hear your seeing some light. Stick with the process and only pay back the borrowed amount. I am paying back some of the fees but no more than that. I know i could fight the fees off but wont. They are in business also and because they were friendly and helpful with the whole situation, I will pay the interest on the initial amount but nothing over that.

Fair enough, Stacy, we all have our reasons in our life choices, and make decisions that we must live with. I'd like to note that my debts weren't all of MY free choice and from actions I made, just legally bound to. State laws vary and many facets may lead one to a bankruptcy, including the adverse spending habits of and lack of commitment and communiation by a spouse. Sometimes, a bankruptcy is the only way truly out. Now that credit card companies can lower a person's credit line without there knowledge, these means of obtaining CREDIT and CASH are becoming more and more unscruptulous (yet remain LEGAL too). All credit card and payday loan compainies make it far to easy to obtain CREDIT and CASH , but make life hell for consumers in general (just my opinions)... I think we all can agree "hindsight is 20/20", but sometimes "you have to do what you have to do" in order to continue being able to support your family...

i'm just curious if anyone knows where i can find a list of internet PDL lenders that are legal or illegal in idaho. i spoke with a rep from cashstar groups collection department and she said they are licensed in idaho, but everything i've ever read about them says they aren't. just wanna make sure on which lenders are certainly illegal and which ones i need to get taken care of. if anyone knows where to find this or can help me figure out the ones that are DEFINITELY illegal in idaho that would be much appreciated. thanks!

so i logged onto the idaho department of finance and did a license search for my debtors and the only ones i found a license for were payday one and cash central. i can't find cashnet usa on there anywhere. i know a lot of people say they're licensed almost everywhere. anyone know for certain they hold a license in my state? i'm so ready to get all this stuff taken care of. i appreciate all the feedback and help you've all been giving me! this site is amazing and a true blessing

thanks nohiogal. after some searching i finally found them as well, but no worries, i've called and taken care of the 3 legal PDLs i had and they've agreed to allow me to make smaller payments through moneyorders. as for the 3 illegal ones, i've received a phonecall from all of them after i sent them the emails stating they were illegal and all that good stuff. funny how i haven't received a single email back from them though. things are looking up for me right now, which is a huge weight off my shoulders for now! thanks to this site and everyone involved with it, i may be seeing that light at the end of the tunnel a lot sooner than i ever thought.

I have got myself into a mess!?? I have 12 online payday loans that are all in default.?? I also live in Idaho.?? I was going to through Oakview lawgroup that I came accross using this web site however they want $1050 just to start helping me.?? It seems crazy to me to pay that much when I can possibly do it myself.?? Are payday loans illegal if they are not licensed in Idaho??? I have researched them and I find that 3 are definately licensed in Idaho and I will call and make payment arrangements with them.?? The remaining ones I can not find.?? I will list them and see if anyone knows if they are illegal in Idaho.?? I have read some of the posts and this seems like a great resource!?? Below are the payday loans.

hey mbrobinson, you've definitely come to the right place. i was totally lost when i stumbled across this sight, ready to give up every shred of hope, but a week later i feel so much better about everything and have a grasp on the situation i've gotten into. the people here are great, full of advice and tips, plus support. they'll help you with templates for letters to send to your creditors and get a jump on taking care of your situation. best of luck to you and i hope you have some success in getting control of your pdl problems
