I received a call from a Daryl at Lakeside Rec. He stated that he has a pending lawsuit against me from a loan with Cash Jar for over $2800. This is the third collection agency that has called me. I have explained to them that I Cash Jar is not licensed in my state (IL) or anywhere in the US and that I have over paid. The loan was for $600 and I paid back $1117.50, last payment was in Feburary. He had my closed checking account info and the personal references listed on the CJ application. Daryl went on and on stating state and federal laws. He indicated that if I agree to a settlement of $178,they would drop the lawsuit. Otherwise they will proceed with it and also go after any refund that I may receive from my Federal income taxes. I worried about this and want to find out if they are ligit. Can a CA sue you and go after your tax refund? :(

no,only the IRS,or any STUDENT LOANS can get your tax refund.this is another bottomfeeding collector.i'm almost sure the laws he was stating either don't apply,or don't exist.whatever actions you took against the other two CA'S take with this one.also if you live in northen illinois like COOK,KENDAL,LAKE,OR DUPAGE counties you must be served by the sheriff personally.nobody will call in advance.being in illinios myself i can state what this cretin spouted was nothing but empty threats as their are no federal laws in regards to pdls.

The more I read on this forum about illegal PDL's and CA's the madder I get! Most of us have been through this and it's maddening that there's no way to stop it!! I have sent letters to Senators in the PDL states and mine to be totally ignored. One of these bottom feeding scum companies has stolen my identity and impersonating me. I worry on a daily bases, will they take out internet payday loans with my information, will they commit a crime or traffic violation and provide my information? I have filed all of the necessary reports, that doesn't keep me from worrying. These people are untraceable, other's that I know have tried. Why won't anyone out there listen to us?

I received a call again late yesterday from Lakeside informing me if I dont agree to their settlement offer I would be served a summons at work. I'm really worried about this. Has anyone ever been served a summon from a CA collecting from a unlicesed lender? I really need some advise on how to handle this.

again lies.nobody receives a summons at work.they say that to scare you.don't believe it.please do not speak to these idiots any further.next time they call just state you will not speak to them until you receive something in writing.then hang up.it's not worth your time to listen to their garbage when they can,and will do none of it as this lakeside is also unlicensed therefore a bottomfeeder.to add since you are in illinois again you must be served in person AT HOME.file a police report for the calls as they are breaking the law with their threats.also file AG,AND FTC complaints.use the name of the bottomfeeder,or any phone number you have.above all else please stop talking to these losers.if you get caught on the phone.hang up without a word.that is the least they deserve.to sum it up.an illegal piece of sh*t trying to scare money out of you.file the report, and cpomlaints then ignore their sorry selves.

I did receive a letter from them via email regarding the settlement. I'm only worried because they have my reference names and my HR contact name. My only concern would be if he calls my employer. I plan on filing complaints as well

well email does not count.they must send something via the usps.with at least the following.

1)name of the creditor
2)their name
3)amount of the alleged debt
4)their address and contact info

it's called a dunning letter and if this bottomfeeding slime was legit they would send it.not engage in threats that break the law.chances are good since this is bottomfeeding slime they will contact your hr person.when that happens file another police report.also fill your HR person in.that way they know a piece of garbage will be calling, and most likely going to be rude to them.be procative in this case.also let your references know too as they need to know before the idiots call them.again be proactive here.i know it's not easy, but it will be better than worrying, and it will make it easier if they know in advance.i have been there and can say it does make this easier to deal with.
