Im so glad I found this website. My husband had a PDL with CNU. It was 6 months ago, we have called many times to try and pay them but they say it has been sold to a 3 party. We were contact my Giove law firm and found out they were a fake. Now we have been contacted by a company called national credit works which I have read about on here. Ms Peterson called and wanted the money within a week, she made threats to sue and even for a warrant to be issued. She said they tried to send the payment thru our acct that we had the PDL thur and that it did not clear so she will be issuing a warrant.
Ms Peterson even called my inlaws and gave them a full detail about this account and the warrant being issued. The are 80yrs old and freaked out!
I wrote a letter to CNU stating some of the NM PDL laws and they have not answered.
I dont know what to do about this...any help would be much appreciated!


They can't issue a warrant, nor can you be arrested for owing a debt. You need to file complaints with the FTC, BBB and your AG. I wouldn't admit to owing any debt over the phone, tell them to send you a letter of collection via the mail. According to the FDCPA 3rd party collectors have 5 days after their first initial contact with the debtor to send a letter of collection via the mail.

They have violated the Federal Fair Debt Collections Act (FDCPA) in several ways. If
First, you cannot be arrested for debt so there will be no warrant issued. You cannot be arrested if a payment did not clear either. Both of these statements were lies and in violation of the law.
Second, a debt collector is not permitted to give anyone other than you any details about the debt.
You need to contact your state's attorney general's division of consumer protection and file a complaint with them and the Federal Trade commission.

I have ms peterson who claims she is a pre litigation counsler srry if spelled wrong. But she worked out a payment plan with me for a pdl that I owe from 07. Ive been paying on it cause they said they ould garnish my eages and or sue me. And im on sdi. Im at wits end and cant afford this anymore. The balance never srems to go down eithet
