CashNet USA PDL Default

I live in Texas. I defaulted on a CashNet USA pdl 2 years ago. A few days ago, a woman called me and said she was from the HZB Financial Fraud Department and that CashNet had "recalled" the loan and wanted to prosecute me for check fraud. Because of this, I gave her financial information I shouldn't have without checking thoroughly first. I did a bit of leg work and found out that, as far as I can tell, the loan has been sold several times. I haven't been able to get a hold of NCA to find out if they sold it. I asked her if HZB owned the loan and she said no.

Can they prosecute me for check fraud since any check would have been made out to CashNet?

How much of this call was pure lies and what can happen to me?


HZB Financial is a collection agency. If you have not made any check payment to Cashnet, they cannot sue you for any check fraud. I think that its just a threat to recover money from you. A creditor can at the most sue you and bring judgment against you to recover the debt. Did you provide them with your bank account details?

I did use ACH with CashNet, which is an electronic check. I talked to CashNet and they said the only time they buy back a loan is if there's an error with payments or the loan has been erroneously placed with collections. In my case, they do not own the loan any more and I can't seem to find who has it.

Another question I have is that I've discovered that the legel limit for pdl's in Texas is $500. She stated that the face value of this loan was $1350. I am considering calling her to state the following:

She used many untrue statements in our call therefore I am recinding any and all payments arrangements.

I will send her a debt validation form to fill out (my suspicion is that they aren't licensed in Texas hence the lie about CashNet still owning the loan).

I will settle for $500 as that is the legel limit of pdl's in Texas.

Does this sound workable?
