I am currently dealing with cash one, it is a store front, i think based in california, they only have 5-6 stores with 2 in arizona. my problem is i retained an attny a few weeks ago and i am in the process of filing bk. i have already sent them a cease & desist letter but they still call, everyday i answer the phone and tell them to call my attny but they say no and hang up. they are refusing to take my attorneys info. so tonight the "innapropriate term" lady says they are going to call all my refrences until i pay. i sent their info to my attny and hopfully he will be able to send them somthing. what else can i do to stop these a-holes. i know until i get my case # there is not much i can do. any advice is appriciated.


Document every phone call the time of day, and a name if possible. Yea there is not much you can do until the Bankruptcy is filed, but document so you might be able to use this against them later. file a complaint with the FTC, your local BBB, and the AG office and the dept of finance or whoever handles the collection agency/pdl

takes time, but in the end it will pay off..... I went through bankruptcy and some of them didnt know I had filed, and I didnt tell them until after I received my case number and it felt good to tell them about that case number and they did stop calling after that.....

Contact your references and give them a heads up.....ask them to tell the company not to call..... keep your head up, it will be over in due time, stay positive.

Yes they can-now whether they will or not I don't know. Thats why they had you list the references in the first place. Some places will call the references and try to "embarrass" you into paying.

You may want to try calling the corp office and explain and offer them your attorneys number and see if you can get the calls stopped that way. I don't know that it would work but its worth a try if your desperate.

If they are included in the BK all you need to tell them is to contact your Attorney, if they continue to call you or anyone else concerning this loan, file a complaint with the FTC and contact your Attorney General's office, they are violating a federal law, you could sue them for up to $1000.00 for unfair collection practices.

thats the thing, they are refusing to take my attorneys information. and since i technically dont have my case # yet the "automatic stay" i think they call it hasnt taken effect. my attorney told me bottom line they can keep calling until i get that case #. but he said he will send them a letter saying he is reprasenting me and maybe they will back off. i did send them a letter to their corporate office explaing not to contact me and contact my attorney but the letter got returned as undeliverable, and i got their corporate addy off of their website, so my guess is they just refused to sign for it because they knew what it was. but they are listed under cm retail managment. so if anyone has any other info i would greatly appriciate it. thanks again for the help everyone.

they want to try to get the money from you before the case if filed and it becomes official....they dont want to show up at your 341 hearing...... lol if i remember i think that is what its called..... i went through bankruptcy a couple of years ago... good luck to you

i think it was wendsday when i talked to my attorney and he said he would send them somthing. so far they are still calling. i guess it could be worse. i already told my refrences to tell them they got the wrong number if they do end up getting a call for me. i think legally if my refrences tell them to quit calling them they have to, and legally all they can talk to my refrences about is verifying my information and asking them to pass a message. they cant tell them i owe money and how much. one of the guys left a message on my cell phone saying "i'm calling about the bad check you wrote our company" i dont know if that is legal but its definetly border line.
