can a pdl garnish your wages?

so once again after i fax letters, contact all the guns that I can, cash today ltd calls me at work threatening to garnish my wages. Asking for my payroll dept. I faxed them another cease and desist letter, and asked to speak to a supervisor,, got someone named TJ.. didn't sound like a TJ to me, but they are trying to get me to pay 4000 on a 200 loan that was taken out many years ago. any suggestions??


That is bogus, $4000. What are they smoking. :evil: Anywayz a PDL cannot garnish your wages unless they have a court order period. it is possible for them to do this if they win a judgment against you.

On the other hand, some PDL companies use a voluntary wage assignment in the contracts nowadays. They will have you sighn it to get the loan in case you every default. Once they have it they can send it to your payroll dept for a assignmnet of your wages to them.

I suggest you immediately send a letter to PDL company revoking all voluntary wage assignments. You will also want to send this same letter to your payroll dept. That way you are covered. Best of luck :)

do as anya advises.cash today ltd is totally illegal.they are part of the overseas group of BIG,ROUTE 66,GFSIL.get that letter at least to your payroll.you should be fine if you do.

if they won't accept your offer to pay what you owe.that's there tough luck.have co-workers say you longer work at your place of employment.then try not to speak to them otherwise.they are located in the UK,so they think they are above the law.you tried to square it up.do those things about the calls then don't worry,they can't really do anything but call.

that's good to know. It's been like 5 years since the start of this.. I just wish they would learn, and stop harrassing me. if they really are legit which they are not in the state of CT, then they can send me to collections and get their money that way.. but anyway, thanks for the advice.. i really appreciate it.

I don't think I know the difference between the two, but I know that in CT they can't garnish your wages without going to court and getting an order. I thought it was the same thing with assignment.. but guess not. either way, I faxed them a letter revoking their rights. Do you think they actually got it and listen?

that's the difference.a wage assignment is voluntary.a wage garnishment is ordered by the court.you should have no problem once you revoke there wage assignment.they won't get a court order being illegal like they are.

The difference is this: wage assignment is a voluntary, usually the consumer signs an agreement which is embedded into the loan contract, this agreement basically says the lender can opt to take some of your wages if you default on the loan, however, by law, that wage assignment may be revoked at any time. A garnishment occurs when and if a lender gets a judgment against you in a court of law, in this case they can use this judgment to collect monies directly from your wages, through your employer, however, they are bound by the laws of your state on the amount which can be deducted and paid directly to them. Some states do not even permit garnishments.

As far as this company receiving the revocation, they probably did and most likely won't acknowledge it. As long as you show a copy to your employer they can attempt to attach your wages but won't be successful. No worries, you are covered!
