question?.................

I just defaulted on 2 PDLs, I had more but got them all paid except for these 2.

payday one $500.00 (nothing paid)
cashnetusa $500.00 (paid $143.00)

I just defaulted this past week, and now I get anywhere from 5 to 10 calls per day. I have asked and tried to work out payment plans with both. Neither will accept. How do I get them to work with me?

So now what do I do and how can I get the calls to stop.


Well those lenders are both licensed in just about every state. Also they may be possible installment loans versus a payday loan. So please review your contracts carefully.


Have you tried to set up an repayment plan prior to defaulting? The original creditor is allowed to call to collect on the defaulted balance. Have they been calling your job?

Im not sure. I did try to review my contract, and did not find anything that said installment loan. I took out the loan on the internet as a payday loan, if that makes a difference.

No, they have not called my job yet. But they call my house and cell phone 5-10 times a day, so I imagine it will not be long they will be calling my job. Which will probably get me fired.

I tried to talk to both loan people to work out a repayment plan. Both told me no they would not be willing and I had to pay the agreed upon amount. I would if I had it, but I dont.

Due to the fact that you are in Missouri, they are most likely installment loans, at least CashNetUSA, PaydayOne is probably a payday loan because if my memory serves me, they are licensed in your state. If I were you, I would continue sending them emails propositioning them with a payment plan you can afford. You might also ask if they happen to have a hardship payment plan. Just a suggestion.

just keep trying and keep a copy of everything you send to them that you are trying to work things out with them.

not sure if its legal to call you so many times, but if you know the number... ignore... great feature on all cell phones.... do what you can and they are going to be tough on you, its a given, but they also wont there money, but I am sure if you are showing you are trying to work with them they will eventually work with you, they just wont show those nice cards yet.......... consider it a po.ker game...

Payday One and CashnetUSA are licensed in MO. Being that you already defaulted on the loans I am sure they are not going to be willing to offer you the extended payment plan. Looks like PayDay One is an installment loan.

Another suggestion is if you cannot resolve this with them call both of their corporate offices and see what they can do.

3 calls already this morning.

2 from Anita at payday one. She was very ugly and saying payday one is checking into filing fraud charges. She said they did not have to offer me a repayment plan. And I better find a way to pay the full balance.

The call from CashnetUSA was from a man who didnt speak very good english. I could not understand everything he was saying, and he was yelling. He said he deals with deadbeats like me every day. I told him I was not a dead beat and I was trying to make a repayment plan.

If I send a letter requesting a repayment plan does that stop all the outragous interest fees?

I truly do not understand why these Legal companies are acting this way when you are offering a repayment. Then again I do not trust any PDL company :evil:

I suggest you ignore the calls or hang up! Email them your proposal untill you get an acceptance or some sort of resolution. In the meantime you need to call all their corporate headquarters ASAP and inform them of the rude customer service you are receiving. Document every call and every email response. If necessary you may be able to file harrasment charges with an attorney against these clowns!

Can payday 1 arrest me on fraud charges? They said since I have not made a payment to them that constutes fraud.

I am off work today, but a girl in my office called me and said someone called and left a message for me. She gave me the number and it was payday 1.

I called them paydayone, and talked to a Ken Andrews. He is supposed to be the president. He informed me his staff did not act in an unconvential way. He said, I signed a contract and it plainly stated the terms.

I said, Sir, I am aware I signed a contract and was aware of the terms. With some unexpected expenses I am not able to pay what the terms stipulate. That is way I am asking for a repayment plan.

Ken Andrews said "in the past we have allowed customers to do an extended payment plan", however it was not good for our company, so we do not offer this option anymore."

So what should I do now? I dont have the funds to pay what they are asking and they refuse to let me pay what I can afford.

Absolutely nothing you can do if they are refusing to take an alternate payment. Your bank account is closed and you the consumer have contacted them to repay them and they are giving you hell :evil:

Tell the so called president you are filing a complaint with the BBB and your states Attorney General's office due to unprofessional behavior on their part. Then I would attempt to send them a partial payment by pre-paid debit card or money order. That way if they file a civil suit it shows good effort and faith on your part to repay the company. As I stated keep track of all phonecalls, emails, etc.. from this company. I am shocked that PayDay One is acting this way, I have heard of them being fairly easy to work with in the past. I guess to many folks entered an repayment plan but many folks could not keep up so they are restricitng it now or just too scared to offer you an alternative route. :?

First, they can not take you to jail for a payday loan. This is a scare tactic these loser payday loan companies use to scare people into paying money they don't have. You closed your bank account which is good, so send them what you can and keep a receipt. Confide in someone at work if you can and tell them your situation, then when they call tell them you cannot get calls at work. Let us know what happens. Good luck

All I can suggest is keep trying untill they take further actions. Wether that be small claims or not I cannot say. You just need to make sure you keep trying to pay on your part :?
