I just learned that my payday lender has a cease and desist court order in my state. The order was issued four weeks after my loan was established with the company. The lending company is Everest Cash Advance and my state is California. The loan was on 3/28 for 750.00 and I have paid on that loan to date $3380. How should I go about presenting a request for a refund from this company. I still am paying down on this loan. The court order is ordering the business to disgorge any profits from loans. Should I ask for a refund of $2630?

What good are the court orders if not enforceable. I may report this to the Attorney General if they don't abide by the court order. The order clearly states that they refund any current loans even stating they were not entitiled to principal amount. But, what do the state court orders do to protect the consumer?
