I defaulted on a PAyday loan last month. I was not aware that my checking account was insufficient at the time, hence the payment kick back unpaid. Now they want to have me arrested on criminal check fraud charges. I paid them what I owed them on the loan, plus fines, etc. But that was not good enough. Then I get a phone call from my local police department (I check the caller ID) on Friday morning saying that there was a warrent for my arrest and that I needed to contact the officer that filed the OCC in that state. I worked with him all day trying to get this resolved, So In addition, I had to pay court costs & fines, which I paid also. Then he tells me that is not good enough and that the court would not accept my payment and plan to continue to press charges. I just hope that they don't arrest me over the weekend so I can go to the police department on Tuesday with an attorney. I don't mind going to a hearing before a judge and pleaing my case, but I cannot survive an arrest, espically staying in the county jail over the weekend. I am 60 years old, a teacher and baseball coach. If I am arrested, I will lose my teaching job and have no income. I have not slept in days, can't eat and have thrown up several times. I have a good run up to this point, but I will take sleeping pills before I let them put me in jail. I made a finanical mistake which was not intentional and I made good on the loan. Do I have any rights or recourse to avoid arrest?

thanks...

THEY ARE SCAMMING YOU!!! Debts are civil, not criminal...no one is going to put you in jail. What state do you live in??

They are probably spoofing phone numbers....you need to report this company to our state AG, the FTC and your local police. Shut down your bank account as well....send them an ACH revocation and close your account and open a new one.

Now go get some sleep!!!!

Thinking more on this.....you need to call your bank asap and any charges that have gone thru in the since they started making these calls you need to dispute as unauthorized and fraudulent. It is my feeling that you are dealing with an illegal loan company and they broke god knows how many laws. You have been scammed...big time.
