Hello, I took the first step in closing my bank account last week. My loan with Check Into Cash is now in default. I sent them a request to contact me only through email or standard mail and that I have all intentions of paying off the loan, but they still called my home, work and references all within 15 minutes. They said that they don't have to obey a cease/desist letter. Is this true?


If they are the original creditor, then a cease and desist does not apply to them. A cease and desist applies to collection agencies. Are they legal in your state? If not, you have a negotiating position. I would tell them that you want to negotiate repayment, but not UNTIL they stop calling your work, references, etc.

I did that with several of my PDLs, just allowing them to call my cell phone where I could control the calls I answered. One of them continued calling my place of employment and I told them I couldn't receive calls a work and then hung up without any further conversation. They eventually stopped calling my work.

You were wise to close your account because as soon as they received your letter, they would have cleaned out your account.
