So i called and spoke to the manager today about a replayement plan , and she said that I could come in and pay 272.50 this week and 272.50 in the next two weeks. or that i could give her another check and I could take out a new loan to cover the old one....assuming that I would give her my new check acct number....there crazy....I asked her and told her there was no way I could do that, abnd if there was any way i could make smalller payements- guess what she said----you already know!!!! No----im send them a 20 m/o everytime i get paid to i pay them off!


I had the same problem with Checkngo. Some of you may remember how they told me I had to do it 48 hours ahead of time and pay that day!!!!! Well I filed a complaint with CFSA and called their corporate office and within minutes I was called back by the Regional Manager and I was on the EPP.

Do not take this from them call CFSA and their Corporate office now.

I think people that presume that an EPP is mandatory are mistaken. State laws differ, and where you got the loan, for example, if you got the loan in Utah, an EPP is not mandatory, it is at the discretion of the business. There is also no interest cap in Utah, just an FYI. I also think people forget that these debts can be turned over for collections and be placed on your credit for 7 years.

Kf your gonna love this.. my banking division is going to suggest them changing their "multiple debit" the same day tactic. Though not getting anything, since my bank refunded the overdraft fees, I do feel I have won.

Our Division of Banking has reviewed your complaint as well and is currently corresponding with "check'n'go" regarding the general practices and procedures it uses in handling your account. The Division of Banking has asked that Check 'n'go implement some changes in their procedures, including the practice of presenting multiple debits/Ach transactions to collect one payment.

Thats exactly why we tell people and show them where they can read about the laws of their state. In states where there is no law regarding extended payment plans the lender if a member of CFSA must offer and allow an epp. In states where the lender is CFSA but the state has laws governing an extended payment plan, state laws prevail.

I do believe more people would use the EPP too if they even knew it was available to them at a lot of storefronts. It's obvious by the amount of people coming here saying "Help! I have 10 payday loans!" ( I was one of them a year ago ) that storefronts do not make this information readily available to their customers. Now that I am educated on it, I find myself looking for it if I ever happen to be in a payday loan store again. Honestly, it's only a tiny little blurb in their throw-away pamphlets that are usually somewhere obtruse anyway, like over at the little Moneygram corner of their store. I don't see storefronts ever doing this, but it would be nice if/when they loan to a new customer they state, "Okay, your loan is due on so and so date, and if you find that you will not have the funds, then you must establish contact with us the day before so that we can make an arrangement to get your loan paid off on a short-term plan. However, this will only be available to you IF you inform us ahead of time, and if you have not previously used this plan with us in the past year...." etc.

Also, I have learned that even if the EPP is available to you as by dictated by the CFSA and your state, some storefronts STILL will do everything they can NOT to offer it to you, even when you know your rights and ask for it up front. When I went through this situation a year ago, all my storefronts with the CFSA except for ONE were willing to put me on the EPP, no questions asked. The latter was rude, asked me a bunch of personal questions as to why I couldn't afford to pay them, and then pulled this one: "Well, I don't even know HOW to set one of those plans up on this computer system."

This was my experiance as well. I had store front loans for a long time and several at a time and never knew for all those years there was an EPP available.

They should be posted as big and as bright as the Fee/Interest posters.

The plain fact is they don't want you to do the EPP, they want you to re-loan. An EPP "robs" them of the fee if you don't re-loan. The lack of information keeps the consumer coming back over and over and stuck in cycle forever.

I am not sure where the "Guest" got the idea that an EPP is mandatory. The EPP is an option and if they are member of CFSA, which Check-n-Go is then they must give you the EPP if you request it and is available once a year.

If I had know about the EPP I would have been out of the cycle years ago.

I dont think anyone forgot that Guest. What I do know is the OP laws were reviewed and they were eligible for an EPP according to their state laws and the storefront membership with CFSA. Unfortunately some storefronts will not always offer this repayment plan upfront to a consumer untill they inquire about it.

We all know debts can be forwarded to a collection agency, dept, etc.. This is where the fees begin, etc.. On the other hand if the consumer makes every attempt to resolve the debt before it goes that far then shame the business for not cooperating :?

I had a loan with cashdirectexpress.com and they are funded by GECC who is a member of the CFSA.I asked foR EPP before my loan went to default and was told they don't do that.They just sent me right to collections with Alliance Asset Managment,nasty lawbreaking collection agency.I faxed a complaint to CFSA and never received a reply.I sent a DV letter to alliance through fax and certified receipt mail and I have not heard back from them,I live in PA.

I think we need to realize that while the EPP is definately a positive development, it's also a fairly recent development. When I started PDL'ing, it wasn't even in existence. It figures, it only came out after I started to become PDL-free. :(
Even so, ignorance is no excuse for the storefronts. If they offer it, and the employee doesn't know how to set it up on the computer, then they need to call someone who does!
