Checksmart in Utah - What are their collection steps?

I have defaulted on a loan with Checksmart in Utah - a storefront. I owe them $1200 total, but just could not keep paying the extension fees -I was getting nowhere. I had to pay my house payment and utilities first.

I am working with Oak View Law Group - just started - but today when I spoke to the collection dept at Checksmart corporate they told me I was out of time.

Either I need to go in today or tomorrow and pay a $200 extension fee and give them a new check to "buy me some time" as she put it. She called this the manager's special.

If I do not do that she said they will start the verification process with my employer on Monday. Not sure what that even means.

Does anyone know, here in Utah, what the entire collection process is with them? Will they take me to court, to a 3rd party collection agency?

I'm not sure if I should take in the $200 - which I don't have - or just let Oak View deal with them and see what happens.

I don't really want them to take my pay and I'm not sure if they can do that.

Does any one in Utah have experience with Checksmart and defaulting?

these people are unbelieveable.
So I called the store on Sunday and offered them $200 on my loan, but told them I was not willing to give them a new check and do an extension or the "manager's special" as they call it.
She called up to corporate and of course they said it was either a new check + the $200 or the full amount.
So I said does that mean you are not willing to take my payment? and the gal said no.

I told her that I guess that I would move her to the bottom of the list said I had other payday loans to take care of and those lenders ARE willing to work with me (which I don't know, but I am hoping!!)

Now today I get a call from the corporate offices and they want to know what was my misunderstanding?

Hello?! There is no misunderstanding, but I am NOT going to go $200 more in debt just to extend for 2 weeks.

I filed a complaint last night with the CFSA - I believe they are violating their practices by asking me to extend among other things including harassment.

The EPP through CFSA has to be requested prior to default. How many times have you extended this thing? According to Utah law, it can't be extended beyond 12 weeks from the original loan date. Perhaps you could contact the Utah Dept of Financial Institutions for help. They're licensed as Buckeye Checksmart in UT.
