I went to Checksmart today (A storefront pdl comapny) and begged them to let me take on some sort of payment plan. I offered to pay $150 of the $490 I owed them. The manager pretended like she was going to accept it. She took the cash and she then came back with a money order with "checksmart" written in the "Pay to the order of" box. and then said "Come back when you have the rest. She also gave me a card to corporate and said to call a "Mr. Monroe" if I wanted to possibly make a payment arrangement. Overall she was just a huge
**** about it. I wouldn't of given her the money had I known she was going to do that w/ it.

Please? Anyone advice?

No, she gave me the money order back and said "At least now you can't spend it..." The guy pretty much yelled at me so I hung up on him anyways. God damn, Theres got to be something written out there in SOLID text that says I can pay them back. That pay day loan info site has a big blank spot for where it says payment arrangements.

Wow! There should be options for arrangements. I know that one poster had to try several times to get a storefront to accept her arrangements. I am dealing with stupid ipdls and they are not nice either. What a bitch for giving you the money order back in that way. Maybe you could find out who Mr. Monroe's supervisor is and call him/her. Is he with the corporate or head office? She probably gave you his number because she knew what the end result would be. Keep trying to call and speak to someone who is over him. Also start complaining to your state atty. gen. office about your treatment. It has to be against some kind of law for them to take your money...or not take it but not let you be able to spend it, as the case is.

Was the signature line on the money order blank or did it have YOUR signature?

If YOU signed it (or it was blank) then YOU can endorse the back of the check and deposit it into YOUR bank account til it clears. IF YOU signed it, then the check is yours. ALL YOU HAVE TO DO IS ENDORSE IT ON THE BACK AND WRITE - not used for intended purpose! You have the right to change your mind and not send the money order.

IF, however, SHE signed it, then you might not have any recourse. (I would be suspect if SHE signed it b/c as an employee, she is now purchasing money orders with someone else's money.) You might have a case to argue here.

I have purchased Official Bank Checks (when I was buying a house and needed for down payment, then did not need them) and the bank told me to do this and I did not have a problem.

Double check with your bank for their rules, however, you should be able to get your money back.

Good luck!

Not real sure of there is anything that you can do. You went into an establishment that you owed money to from 5 years ago and they collected it. If you are still in the same area, I have a hard time believing that they "let you forget" about it and you still intended to pay them back. Unfortunately, this is a prime example that debts unpaid will follow you around for a long time. You will probably have to chalk this up to a learning experience...
FYI to others, if you are taken to small claims by a legal lender, that judgment can keep you from getting many jobs. This is especially true in this day and age of high unemployment. It allows employers to be more selective with thier employment requirements and run credit/criminal background checks
