OMG some place called United Processing called me today telling me i was going to jail today for fraud and wireless banking because i have not paid EME Marketing. Well originally the loan was through E-Payday when i took it out. Thanks to all of you I kept telling the guy that the original loan was not through EME that it must have been sold to them and that I had already paid E-Payday $480.00 on a $200.00 loan. Well he kept it up and i kept telling him to send me the paperwork showing that the loan was or EME marketing because my bank statements showed that the day of the claimed deposit was from E_payday not EME marketing. Evenutally he hung up on me. Amazing hugh. What a bunch of jerks. How can they live with themselves telling people they are going to jail the same day they call. That is horrible.

TLM, atleast they did not tell you that you were going to be downloaded  That is one of their usual ploys to scare people into paying them. I personally like the "wireless" banking. Is there such a thing?? I believe the correct term is wire fraud. Next time tell him to come get you. Good job no letting them intimidate you. All they want is the money and they will do whatever they have to do to get it.

tlm, it's amazing how "mean" a person can get after dealing with pdls! Live and learn! And I think they make you "old" before your time!

Try to remember, the United Pay guys are in India and English is very much a second language for them . . .

The way it works is Westbury Ventures buys junk debt from a lot of payday lenders then they play musical chairs by passing it around between their own collections people and United Pay and Bass. Why the U.S. Attorney hasn't indicted everyone involved in this scheme - the lenders, Westbury, Bass and UPS (at least the owner - who lives in Florida) under RICO is beyond me. Correct me if I'm wrong lawyers out there, but I believe lending at double the criminal interest rates (which they regularly do in states which have criminal as well as civil usury) and using extortion to collect are predicate offenses.

Ok, so they called me today as well. They are evil blood sucking parasites, lol. They threatened to take me to jail as well. While I was talking to them, I did research and found this website. I just started laughing at her, and told her, Id be waiting with my suitcases for the cops to arrive. She got pretty pissed.

Maybe in their hometown of Kansas City, the police have nothing better to do than run around arresting people and throwing them into the debtor prisons that were closed 150 years ago. In the rest of the world, the only people going to jail for payday loans are payday lenders themselves. (Don't take my word for it. Just look up the convictions in Georgia and Florida in the last few years of guys running illegal loan stores.)

I can sympathize, as, per my post, I'm going through the same thing with achloan.com. It's getting to where I'm almost "enjoying" their calls in a sick sort of way; when they start yelling, it's almost like an old melodrama, isn't it? I swear, I'm going to start getting naughty when they call, when I hear who it is, "hey buddy, how are you doing? Long time, no hear", you know?

Do it! That's one of the best ways to deal with these calls, have some fun with them. They can't do anything to you, and it's fun to turn the tables and let them have a taste of it.

Some suggestions are to whisper, talk in jibberish, repeat everything they say, etc . . . . In general just act like a 3 year old. It's fun, and it helps break the tension of their call . . . . Plus they will eventually get sick of it and give up.

Welcome, tmt! I'm sorry to hear about your job loss.

It would probably be better if you started a new thread in the payday loan section. Also, you will need to provide the following information in order for folks to be able to give you the best advice: what state you are in, each company you borrowed from, whether they are internet or store front, the original amount borrowed from each, and the amount paid so far to each. Once you post that information, someone should be able to start giving you some advice.

 this place is evil. I had called eme to make my payment 3 days later then the agreement .. they said ok.. next thing i know they had sent it to the thier collections. so I go ok. whats the number there. all I get is a bogus phone number. I called them back to let them know this number is a bogus phone number. they then tell me to fax them. well I did been 4 months now still trying to pay them. So i figured most collections would be calling you alot for thier money. they have all my information. so why arent they contacting me to work out arrangements? Sense i have no way to get a hold of anyone at eme to help me pay them. I am clueless on what to do?

They are probably wanting the interest to grow larger and larger before they call you with some outragous amount they say you now owe.

I would forget about it until you get some sort of colleciton call or letter. Then you can dispute the debt.

Either that or get a MO and mail it to them and state that is the final payment and keep all records and receipts. Make sure you send it registered mail with return reciept.

You need to call these guys back at about 7am your time. I received a call from an Officer "Tom Scott" claiming the same as most of the rest of the posts. He'd also contacted my adult daughter in another state. In the evening when I called the number (206-855-5350) the voice mail said William Walter (it was the same voice as the voice mail on both my phone and my daughter's phone). I've dealt with this scam before, so I called early in the morning and asked for Officer Tom Scott. I had done my research already and was pretty certain this was a scam. He told me he was Officer Scott's supervisor William Walter. It wasn't until later that he added Officer and a phoney badge number. He started trying to verify my info. I stopped him and asked what company he was "collecting" for. He gave me some vague BS about EME Marketing who owns a host of internet payday loan companies (he sounded like a commercial for them). I stopped him again and insisted on WHICH company. I told him I would not confirm or deny anything until I knew who the company was. He got frustrated and told me to stop interrupting him so he could finish reading his prompt. I nearly laughed out loud at that!
Anyway...long story longer. I got a little more info out of him and then laid into him. I told him the call was being recorded and that my attorney was working with the AG for my state and the call was being traced. I informed him that he was in violation of numerous FDCPA laws, federal and state laws--including impersonating an officer, in violation of US Bankruptcy laws, Identify Theft (which is a 20 year imprisonment and $100,000 fine) and repeated FTC violations as well. He got a little incensed and insisted that he was an officer and repeated his "badge #". I told him I could say I was Officer Suzy Q with badge #123 and that didn't make me an officer! He then tried to tell me I was breaking the law by calling him before 8am. Again...almost choked on the laughter. I let him know those provisions of FDCPA applied to collectors, not consumers. I ended up my pleasant little conversation with him by telling him I'd already contacted EME and they not only didn't have an officer Tom Scott or William Walter working for them, that they did not use any outside collection agencies to collect. So add hacking into a company's data base to the list of illegal activities!
By this time he's angry and goes into a loop--repeated what he'd already said. I told him my attorney would be contacting him and we were cooperating with all authorities to pursue him to the fullest extent of the law. "Officer Walters" told me he hopes I can sleep at night and hung up. We have a trace on the number which is "assigned" to Belleview, Washington but is actually running out of the West Indies.
So to sum up my advise: Call them back (but hide your ID or they most likely won't answer), call early in the morning. Do some research and DO NOT give them ANY information about yourself no matter what they say. Turn everything you have over to the FTC, BBB, and local law enforcement. You may need to contact the 3 credit bureaus to notify them of ID theft if they do have your info. Good Luck and don't let up on the crooks!
