I am in deep with some payday loan companies.the interest costs were so high that I couldn't afford to pay my mortgage, car, electricity etc... I've looked them up and all 5 are not licensed in Illinois. I followed the steps... closed my bank account, sent letters of revoke for ACH and wage assignment and gave copies to my employer. I included a repayment plan in each of the letters all except for one which I have over paid the principal in interest alone. Anyway, I have yet to hear from any of them and I'm nervous and scared. My family is saying that I committed fraud by closing my account and that I will have my wages garnished. I will be further in trouble due to fraud. I am so scared... I have four babies to support and had a back injury...thats what got me into this mess...had to have money to feed my family!! I want to pay them back which is what I put in my letter! My family is scaring me with the talkof fraud!!! Should I get a lawyer? What's going to happen??? Please help!!!!


i think waffles that either one family member knows somebody ,or is connected to the pdl industry,or a bpttomfeeder that collects as we do have a few in IL.alliance assett comes right to mind.i just don't excuse this ignorance in cramming down her throat the fraud part.that is ignorant,and stupid.if i were the OP i would break away until i got back to some normalcy financially.then state what you said waffles.

Ignore your family....they dont know what the hell they are talking about. Fraud is a criminal offense....debts are civil. The LENDERS are the criminal, not following your state law and charging usary rates of interest. You dont need a lawyer...you just need to stop listening to people who dont have a clue. Send them here...I will set them straight.

being in IL i agree with soaplady.not only are the loans illegal,but your family has no clue of what they speak.even as soaplady stated the debts are legal it is a civil matter.if you are going to listen to people listen to us please and don't worry.

I just want to pay back what I morally need to catch up on my mortgage and car payments and be able to provide for my four children!!! It made me sick that I didn't have enough money to get my daughter shoes that she needed!! I just want to be a good person and not get into trouble!!! It scares me that I closed my bank account as if I'm running from a problem...but there is no other way to not loose my family's' home!!
I'm just nervous now! How do I know these lenders received my letters?? I emailed all of them and faxed to hydra fund 1 because all I have is a fax number for them...

Hang in there! I am sure that they received your letters. They are just trying to figure out another way to get you to pay. Remember, you control how things go. Pay them at your convenience when you can and keep us posted. We are all here to help!

you is filling your head with these ideas?you are not a bad person,and you are solving a problem not running from one.you really need a break from your family as they are not helping with their idiocy.btw since they can't access your money you catch up on the mortgage,car payment,etc just as bingonut stated.these illegals can wait as they put you in this position.

While I can understand what your family is saying, namely because its hard to comprehend the fact that lenders are giving loans illegally and you technically have no legal obligation to pay, they need to leave you alone. Tell them the matter is handled and you're not interested in arguing further.

I just got this e-mail from hydra fund 1....I've over paid them already...what do I do???

You expressly acknowledged and consented to be governed exclusively by New Zealand law when you signed your loan agreement. You were also given the option to rescind your loan agreement after it was executed, which you chose not to do.
 
You are bound by New Zealand law and must satisfy your debt pursuant to the terms of your loan agreement. If you fail to do so, Hydra Financial Fund I has the right to pursue remedies against you available at law.
 
Further, because you have revoked authorization for ACH withdrawals, you are required to immediately provide another payment method that is acceptable to us. ok, not to bother all of you again, but I am just wanting to ask some more advice. I received an email from Net Cash 123 stating that they will work out an agreement with me to pay the principle balance of the loan, so that's good.
However, Castle Payday, Payday Max or Bottom Dollar Payday have not contacted me yet. I sent letters over a week ago now, and closed my account, so on Friday they did not get the payments. I checked each of the sites to log onto my account and this is what I got:
Payday Max- when I tried to log in I got a pop up "Payday Max no longer lends loans to Illinois residents." And My account is gone.

Castle payday- when I tried to log in - "invalid log in, no account found."

Bottom Dollar Payday- when I tried to log in- "Please contact customer service to get information regarding current loan information.

Not sure what to do from here....I have not gotten a single phone call or email or letter from any of these three companies. Do I send another letter? Or just wait? Have they sent my accounts to collections? I just get nervous when I have had no response at all and now my accounts on their web sites are closed. Shouldn't I have heard from them by now?

I just paid my auto loan up to date and feel so good that my vehical is not going to be taken away from me...

Resend your letters. They are just trying to figure out another way to make you pay. If you dont hear from them, just forget about them.

Again...ignore your family....and you do not need a lawyer. Your loans are illegal...meaning the loan docs are NULL and VOID. Legally you do not owe them one penny!!! You are following the correct path...follow it.

I have given the wage assignment revoke letters to my employer, however, they stated they will not honor it without a lawyer involved. So now what? I'm scared, I can't have my paycheck taken nor can I afford a lawyer at this time! So these illegal companies can just write a letter and they just get my money with no questions asked??? I guess I better find lawyer?? What should I do???

You need to talk to someone else in payroll. Wage assignemnt is not a garnishment, it is not court ordered.
Unlike wage garnishments (where the court orders the employer to make payroll deductions), a wage assignment is a voluntary agreement between an employee and a creditor.

No one in payroll will help me!! They all say I need a lawyer!! Is it possible that these illegal companies not go after my wages?? They all received the revoke letters...so legally they can't continue with wage assignment... right??? Not that I've found...they all seem linked. I never saw a website or anything with them...just all of a sudden money was deposited into my account with hydrafund1 and a phone number attached. I later got an email with only the phone number and fax number...not even a return email! I am having a hard time convincing them through fax that I've over paid...just difficult!

I just received this email...now what? I don't know the company they gave my "account" to...plus I have already over paid hydra fund 1 according to my state of Illinois law....please help me...I just don't know what to do..I have not received any phone calls or emails regarding this from any collection company yet...I haven't heard from any of my other payday loan companies as of yet either...but anyway, here is the letter, just wondering what to do from here..

Weird numbers have called me all morning...I haven't answered them, and no message is left to even know who it is...should I answer just to find out who they are...or just continue to ignore?? In all of my letters I made sure to put all communication is to be through email only. So do I answer???

I would just ignore. I have answered bottomfeeder CA calls before and they can be extremely nasty over the phone. Yelling at you, threatening arrest. Sometimes they will claim to be from a federal agency like the FBI, etc. All scare tactics to try and force you into giving them money. Definitely let whoever you put down as references on your loan know they may also be receiving calls and that it is a fraud and they should ignore it.

I hate to keep asking this, but I've yet to hear from payday max, castle payday, bottom dollar payday and cash taxi. I can no longer log into any of their sites and it has been two weeks already... is this normal? I never even got a generic reply...why haven't I heard anything??? Should I call to initiate things...the waiting is killing me...thanks for your help...

aimee, stop worrying over this. The lenders take time in responding. If you dont hear from them, consider that a good thing. All of us here at one point in time or another, have been in the same boat as you, and we have survived. Hang in there!!!

Thank you!! I am a worrier by nature!! I guess I just don't want them going straight after my paycheck since my payroll department won't do anything without a lawyer...so I was hoping to at least get contacted first so I have the heads up to get a lawyer to stop the wage assignment. Otherwise I just feel likethey are just going to send it to my employer without notice to me...and that will be awful!!!! So thanks again for your support! I felt alone in this...now not as alone!! Just wish my employer payroll department knew the law without a lawyer...my mind would be much more at ease!!! Plus where I live I'm having a hard time finding a lawyer that deals with this!!
